Special counsel Jack Smith has charged former President Trump in a superseding indictment related to his federal election subversion case.
Though the special counsel has trimmed the allegations against Trump, critics maintain he is undermining the Supreme Court's July ruling on presidential immunity.
The indictment against Trump follows the landmark ruling that former presidents have partial immunity from criminal prosecution.
Politico has more information about the latest development in the election subversion case:
The 36-page indictment, secured Tuesday by special counsel Jack Smith, is an attempt by prosecutors to recalibrate the case against Trump in light of the Supreme Court's ruling last month that concluded presidents enjoy sweeping immunity from prosecution for their official conduct.
The new indictment removes some specific allegations against Trump but contains the same four criminal charges, including conspiracy to defraud the United States. It's a signal that Smith believes the high court's immunity decision doesn't pose a major impediment to convicting the former president.
“The superseding indictment, which was presented to a new grand jury that had not previously heard evidence in this case, reflects the Government's efforts to respect and implement the Supreme Court's holdings and remand instructions,” Smith's team wrote in an accompanying court filing.
In an apparent bid to downplay any connection between Trump's conduct and his official duties, the new charging document repeatedly emphasizes the political and personal nature of many of the actions Trump took during the post-election period and on Jan. 6, 2021.
On July 9, the Supreme Court ruled 6-3 that presidents are entitled to absolute immunity from criminal prosecution for official acts conducted while in office. However, the ruling clarifies that this immunity does not extend to unofficial acts.
The decision to grant the former president “partial immunity” sparked widespread speculation about who benefited the most.

Enough is enough! What ever happened to the case that Joe Biden, while Vice-President, took classified files to his home and kept them. This is a witch hunt that Jack Smith is on to prevent the legal process of a Presidential election take it’s legal course.
Enough with the continued games. Let the case go on, if Jack Smith loses he should be responsible to the taxpayers. Is he willing to take this kind? He should be fired just attempting the waste of taxpayers funds.
What does he have to lose, is he willing to put his job on the line?
I wish these Democrats would go home and shut up. What really needs to be done is take the United States District Court for DC and disbar all of them. They are not doing any good for America. If the Democrats get back in office that will be the end of America. They don’t seem to care. If they want to live in a Socialist Country, put them on planes and send them to Russia, China, North Korea, Iran and any other Socialist country. We will not miss any of them and then we will get our Great Country Back.
