California Governor Proposes Constitutional Amendment To Curb Gun Rights

Governor Gavin Newsom (D) is proposing a 28th Amendment to the to take away gun rights.

On Thursday, the Democrat governor announced the proposed 28th Amendment that would implement “commonsense” gun safety measures he claims have widespread bipartisan support.

“Our ability to make a more perfect union is literally written into the Constitution,” Newsom said Thursday. “So today, I'm proposing the 28th Amendment to the United States Constitution to do just that. The 28th Amendment will enshrine in the Constitution commonsense gun safety measures that Democrats, Republicans, Independents, and gun owners overwhelmingly support – while leaving the unchanged and respecting America's gun-owning tradition.”

The Democrat governor's proposed rule would not abolish the Second Amendment, which establishes a right to bear firearms for personal self-defense.

However, the 28th Amendment would raise the federal minimum age to purchase a firearm from 18 to 21; mandate universal background checks to purchase firearms; institute a waiting period for all gun purchases; and ban “assault weapons.” 

can pass a proposed amendment with a two-thirds vote in both the House and Senate, sending it to the states for ratification or a convention of states under Article V can amend the Constitution.

However, as Republicans currently hold a slim-but-solid majority in the House of Representatives Gov. Newsom is calling for an Article V convention of states to convene and draft his proposed amendment. 

Before the amendment could be considered two-thirds of the state legislatures must pass a resolution calling for such a convention. If the convention succeeds in the uphill battle of adopting a proposed amendment, it then heads back to the state legislatures for ratification. 

Three-fourths of the states must ratify the proposed amendment for it to be added to the Constitution.

Newsom's proposal has already drawn harsh criticism from prominent gun rights groups across the country

“Newsom's latest publicly stunt once again shows that his unhinged contempt for the right to self-defense has no bounds,” the National Rifle Association said in a statement. “California is a beacon for violence because of Newsom's embrace of policies that champion the criminal and penalize the law-abiding.  That is why the majority of Americans rightfully reject his California-style gun control.”   

“We've always warned those who cherish their God-given liberties that the ultimate goal of anti-gunners was the abolishment of the Second Amendment,” said Erich Pratt, senior of Gun Owners of America (GOA). 

“While they often try to hide behind legislative proposals and hush open talk of abolishing the Second Amendment, here we have a potential future presidential candidate now coming out and openly admitting what they've wanted to do all along,” Pratt said. “GOA will strongly oppose this proposal as we work to protect and restore the Second Amendment rights of all Americans.”

  1. First they will go after the Second Amendment, and then the First Amendment.
    If or when that happens, I’m afraid that Blood will run in the streets.

  2. Not one part of Newsom’s proposed “amendment” belongs in the Constitution. No age of majority for any natural right exists within it, minimum ages for Representatives, Senators, and the President notwithstanding. background checks or waiting periods are purely administrative functions, inappropriate to the Constitution, even if felt necessary in whole or in part for record keeping. “assault weapons” is an arbitrary made up “appearance” criteria that conflicts with the intent of the second amendment, in spite of which Newsom may pretend to believe.

First of all, as a citizen who believes our elected officials and government should follow the Constitution and our laws, I acknowledge and support the Constitutional amendment process as the LEGAL way you change our highest laws. I have often criticized leftists, including Newsom for illegally ignoring our laws, including the Constitution and the Bill of Rights and NOT pursuing the changes they want through lawful means.

    Having said that what Newsom proposes above is:
    a) Pure propaganda
    b) Disingenuous

    To point a) notice Newsom does not provide ANY evidence that anything he has proposed will work. In point of fact, there is A LOT of evidence, even experience that it won’t. Instead, he supports his proposal with propaganda vis-a-vee “common sense”. In other words, if you don’t agree with me you are a fool.

    Merriam-Webster defines common sense as: “sound and prudent judgment based on a simple perception of the situation or facts”. However, Newsom’s proposal provided no facts, nor any indication that it was based on any informed perception–much less sound and prudent judgment based on the situations that have arisen or those facts. Thus his appeal to “common sense” was completely eroneous.

    • His comments about adding a 28th amendment is pure politics. As stupid as he is, even he should know that it would not happen, because once, if ever, congress debates it and passes it, and sends it to the states, there would never be the required number of states approve it. Once it got to the states they have 7 years to pass it, if not it just goes away, which is what should happen.

  4. Tell that COMMIE to go back to KALIFORNIA where he belongs and continue to RUIN that state . . . The VOTERS in that state DON’T get it.

  6. “Assault weapon”, noun, any device or contrivance used by a person to bestow damage upon another such as to include automatic and semi automatic firearms, artillery, explosive devices, bows and arrows, spear, swords, sabres, bayonets, rope, duct tape, poisons, toxic cleaning compounds,old sushi, gasoline, diesel, natural gas, propane, scythes, hoes, clubs, knives, baseball bats, shovels, pitch forks, automobiles, trucks, tanks, and, of course, keyboards.
    The definition is subjective. Example, an athlete does not consider a javelin an assault weapon unless it was thrown at them and thus relabeled a “spear”.
    a steak knife is not an assault weapon lest you are a cow or about to be treated like one.

  7. I don’t have a gun – none at all. But when I am out, I always hope a good guy or gal with a gun is nearby. The bad guys will have a gun because they are bad guys.
