Key Parts of New York’s New Gun Law Blocked

-

State's gun laws are once again facing legal challenges. In the wake of this summer's decision in the National Rifle Association-backed NYSRPA v. Bruen case, the state was forced to revisit its conceal carry restrictions when SCOTUS ruled the then-existing “may issue” rules for concealed carry permits violated the constitutional rights of New Yorkers.

New York Governor (D) then called on legislators to return to Albany for a special session to pass new restrictions.

The new New York laws went into effect last month on September 1st.

In another major win for the pro-firearms community, a federal judge ruled the following today:

Key provisions of New York's latest attempt to restrict who can carry a handgun in public and where firearms can be brought, saying multiple parts of a law the state passed this year are unconstitutional.

U.S. District Judge Glenn Suddaby focused on multiple parts of the law, saying licensing requirements — like a rule requiring applicants to turn over information about their social accounts — went too far, ” as reported by CBS News.

As reported by Armed American News, the “lawsuit was brought forward by Gun Owners of America and Gun Owners Foundation on behalf of six individuals”:

“Erich Pratt, Senior of Gun Owners of America, applauded the decision but warned about gun control advocates' future moves.

“Anti-gunners are trying to find loopholes to circumvent the Supreme Court's Bruen decision from earlier this year that reaffirmed your God-given right to keep and bear ,” Pratt said in a statement on the Gun Owners of America website. “That's why we're fighting so hard to OVERTURN New York's draconian gun control law that puts virtually the entire state off limits to concealed carry permit holders.”

In more bad news for New York gun grabbers, Michael Henry, New York's Republican candidate for Attorney General also shared today new polling conducted by the Trafalgar Group that shows him with a slight edge over incumbent Democrat AG who has constantly assaulted the rights of law-abiding gun owners throughout her time in office.

Trafalgar often touts their record as the “consistently most accurate pollster of ‘16, ‘18, ‘20 and ‘21 election cycles.”

James has attempted to destroy the Second Amendment community at every turn. Just last month, she signed on to a letter with her counterpart Rob Bonta which encouraged “credit card companies to create a spending merchant category code (MCC) for firearms, which would allow to better deter firearms trafficking and potentially serve as a warning sign of potential mass violence.” (RELATED: The Government is Targeting Gun Owner Data. Who is Stepping Up to Protect It?)

As American Liberty News previously reported, despite the fact that the decision to create an MCC was made, “at least one major credit card company — VISA — has stepped up with a strong statement … condemning activists asking them to flag fully lawful transactions.”
