In an impassioned exchange with Benny Johnson on The Benny Show podcast, prominent conservative lawyer Mike Davis issued a fiery warning to New York Attorney General Letitia James, vowing legal consequences if she continues what he described as a politically motivated “lawfare” campaign against President-elect Donald Trump.

“Listen here, sweetheart, we’re not messing around this time, and we will put your fat ass in prison for conspiracy against rights. And I promise you that. So think long and hard before you want to violate President Trump’s constitutional rights or any other Americans’ constitutional rights. It’s not going to happen again.”

Davis has been a vocal critic of “lawfare” or the strategic use of legal action for political purposes, with many legal experts agreeing that New York Attorney General Letitia James’s cases against Trump are a prime example of it. Lawfare, in Davis’s view, undermines the integrity of the legal system by turning it into a tool of political retribution rather than a means of seeking justice.

Following Donald Trump’s decisive victory in the 2024 presidential race, winning not only the Electoral College but also sweeping the popular vote and every key swing state, James publicly stated that her office was “prepared to respond” to the election result, signaling that she intended to continue her legal battles against the president-elect.

“We are prepared to respond to this result, and my office has been preparing for several months because we’ve been here before. We faced this challenge before, and we use the rule of law to fight back, and we are prepared to fight back once again, because as the Attorney General of this great state, is my job to protect and defend the rights of New Yorkers and the rule of law, and I will not shrink from that responsibility.”

Davis’s threat was framed in a legal context, invoking the federal felony statute for “conspiracy against rights,” under 18 U.S. Code § 241. This statute makes it a crime for two or more people to conspire to deprive someone of their constitutional rights, a charge Davis suggests may apply to James if she continues with her legal pursuit of Trump.

Referring to her ongoing lawsuit against Trump, he predicted that even Democrat-appointed judges on the New York Appellate Court would likely overturn the case on appeal. The legal challenges James has pursued, Davis contended, were without merit and would not hold up in court.

Davis is the founder of the Article III Project, an organization focused on defending the rule of law and advocating for the appointment of conservative judges. The group positions itself as a counterweight to what it perceives as an ongoing effort by the political left to weaponize the legal system against conservative figures, particularly Donald Trump.

As Trump prepares for a second term, the clash over “lawfare” promises to be a key issue moving forward. Whether Davis’ threats of legal action and criminal charges materialize remains to be seen, but one thing is clear: the stakes in the legal fight between the Trump camp and its adversaries have never been higher.
