Special counsel Jack Smith has officially moved to dismiss federal charges of election subversion following the 2020 presidential election against President-elect Donald Trump. He will also dismiss the classified documents case against Trump, potentially as early as today. The decisions stem from a Justice Department (DOJ) policy prohibiting the prosecution of a sitting president, signaling the end of the high-profile legal battle.

Smith’s motion to drop the charges comes as Trump prepares to assume office. In court documents, prosecutors stated that the DOJ’s position “is that the Constitution requires that this case be dismissed before the defendant is inaugurated.”
DOJ had indicated its intention to wind down its criminal cases against Trump hours after his reelection, with many observers expecting any ongoing investigations to conclude before Trump’s inauguration on Jan. 20. The timeline underscores the department’s policy aimed at preserving the constitutional separation of powers.
Initially, some speculated that Smith might seek to expedite proceedings, potentially forcing Trump to intervene or prompting swift DOJ handovers under the incoming administration. Reports suggested the possibility of Smith continuing efforts until the final moments before Inauguration Day.
However, Biden administration officials ultimately chose a restrained approach. “The thinking inside the department is that these cases can’t go forward under DOJ’s policy,” one said. Rather than escalating legal battles in the final weeks, the DOJ has opted to suspend proceedings in light of Trump’s impending inauguration.
