The House Oversight Committee has withdrawn its subpoena for former FBI Director and special counsel Robert Mueller, citing health concerns that render him unable to testify.
“We’ve learned that Mr. Mueller has health issues that preclude him from being able to testify. The Committee intends to withdraw its subpoena,” a committee spokesperson told The Daily Caller.
Questions about Mueller’s health have intensified since RealClearInvestigations reported on Aug. 6 that he has been living in a memory care facility for several years. The decision to drop the subpoena comes just days after Chairman James Comer announced a new wave of subpoenas targeting key figures tied to the FBI’s handling of the Jeffrey Epstein investigation.
Mueller led the FBI from 2001 to 2013, including during its early probes into Epstein. He later served as special counsel from 2017 to 2019, investigating alleged Trump-Russia ties in the 2016 election — an inquiry the 2023 Durham Report faulted for bias and for ignoring intelligence that the Clinton campaign had manufactured the narrative.
His reported condition is reminiscent of his subdued and at times confused testimony before Congress in 2019, which fueled speculation about his cognitive state even then. That appearance came just weeks after he stepped down as special counsel.

The committee’s interest in Mueller centers on a long-buried FBI investigation into Epstein. Recently released records obtained through a Freedom of Information Act (FOIA) lawsuit confirm Epstein served as an FBI informant well before his controversial 2007 plea deal. A 2008 FBI memo plainly states: “Epstein has also provided information to the FBI as agreed upon.” It further notes, “no federal prosecution will occur in this matter as long as Epstein continues to uphold his agreement with the State of Florida.”
That agreement, negotiated by then-U.S. Attorney Alex Acosta, allowed Epstein to avoid federal charges despite copious evidence of sex trafficking of minors. Instead, Epstein pleaded guilty to lesser state charges and served a 13-month sentence, much of it under relaxed work-release conditions.
Sources familiar with the case say Epstein’s cooperation with the FBI began long before the 2007 deal. “These are the smoking gun documents,” one insider told Radar. Another called Epstein “a puppet, informant, and spy for the FBI.”
Acosta, who later served as Labor Secretary under President Trump, claimed he was told to “leave it alone” because Epstein “belonged to intelligence.” The newly surfaced records appear to lend weight to that claim.
Critics have long pointed to Epstein’s unusually lenient non-prosecution agreement — which also shielded alleged co-conspirators — as evidence of political interference. Among those granted immunity were four of Epstein’s close aides: Sarah Kellen, Adriana Ross, Lesley Groff, and Nadia Marcinkova.
“You don’t give this kind of deal to a man like Epstein unless you’re getting something big in return,” a legal source told Radar.
Another source added: “The real reason the FBI has been stonewalling for years is because these files blow up the official story. Epstein wasn’t just evading justice — he was helping them.”
The FBI continues to withhold a large tranche of Epstein-related records, citing ongoing law enforcement exemptions. But the documents already released have reignited debate over whether federal authorities enabled Epstein instead of stopping him.
“The public deserves to know what he was trading for that protection — and who else was involved,” said a source close to the FOIA litigation. “Epstein wasn’t just protected by power. He may have been an instrument of it.”
Despite pulling Mueller’s subpoena, the Oversight Committee’s investigation is moving forward. Former Attorney General William Barr is scheduled to testify Monday as the first witness.
Others who have been subpoenaed include:
- Former President Bill Clinton
- Former Secretary of State Hillary Clinton
- Former FBI Director James Comey
- Former Attorneys General Loretta Lynch, Eric Holder, Jeff Sessions, Alberto Gonzales, and Merrick Garland
The committee is seeking both testimony and records related to these individuals’ knowledge of the FBI’s actions surrounding Epstein.
By stepping back from forcing Mueller’s appearance, the committee avoids a likely clash over his ability to testify, while keeping its broader focus intact: uncovering how federal agencies handled one of the country’s most disturbing criminal scandals.
The investigation continues amid growing calls for transparency and accountability in a case where powerful interests shielded a known predator for years. Epstein died under mysterious circumstances in federal custody in 2019, while his longtime associate, Ghislaine Maxwell, is serving a 20-year sentence for conspiring with him to abuse minors. Since when are “Health Concerns” a viable excuse not to testify in front of Congress. It seems to me that many of the people involved with the J6 jailing had health issues and were forced to do a lot more strain on their “health concerns” and NOBODY paid any attention to them, leaving some to die in DC Prison.
If Comey had been a Republican in a Democrat congress, this would not happen. The Republicans are spineless
