Federal Courts Step In
Two federal judges have ordered the U.S. Department of Agriculture to tap emergency funds to continue paying Supplemental Nutrition Assistance Program (SNAP) benefits during the ongoing government shutdown.
Judge John J. McConnell of Rhode Island directed the USDA to access roughly $5 billion in contingency funds “as soon as possible” to make November payments. Judge Indira Talwani of Massachusetts similarly ruled that the agency’s suspension of benefits was likely unlawful, finding it based on an “erroneous construction” of federal law. Talwani instructed the USDA to inform the court by Monday whether it will issue full or partial benefits.
A Lifeline for Millions
SNAP serves about 42 million Americans — nearly one in eight — each month. Both rulings prevent a lapse that could have inflicted widespread harm on low-income families.
“There is no doubt and it is beyond argument that irreparable harm will begin to occur if SNAP benefits are not paid,” McConnell wrote. Experts warned that any interruption could exacerbate food insecurity, heighten stress for families living near the poverty line, and overwhelm food banks and local economies.
Legal and Administrative Hurdles
The decisions represent a setback for the administration’s claim that it cannot use contingency funds without new congressional appropriations. The judges rejected that interpretation, ruling that the USDA has the authority to deploy existing resources during a shutdown.
Still, key uncertainties remain. Because state systems must reload benefits, recipients may face delays even if funding resumes immediately. And since the contingency fund covers only $5–6 billion — short of the $8–9 billion needed monthly for SNAP — payments may be reduced or partial until Congress passes new funding.

The USDA could appeal or seek further relief from the courts. Even if SNAP payments continue temporarily, the broader funding impasse that caused the shutdown persists, leaving social safety net programs vulnerable.
Impact on Families and States
For recipients, the rulings are a relief — benefits should not stop entirely, though delays are possible. States administering SNAP must now coordinate closely with the USDA to determine payment schedules and prepare for partial distributions, as needed.
With the holidays approaching, the stakes are high. Any disruption in food aid would disproportionately affect children, elderly and disabled individuals, and working families already struggling to make ends meet.

This is BS. I dont understand how these judges have the authority… or if they really do. It always blue state judges or ones that have names you can not pronounce. So no big surprise.
Americans are tire of this… I’m willing to bet more than 75% of benefit recipients are scammers… overweight, don’t work and are able to… section 8, EBT, SNAP and every other government benefit, they can get their hands on, not to mention all of the child credits… It was laid out for me the other day how they can get the equivalent of a $60,000 yr job just in just government benefits, of coarse by scamming, cheating and lying.
Most Americans go through these same struggles that were mentioned in this article on a daily, weekly, monthly and yearly basis ourselves… but we’re working our 40+ hours a week, and yet our tax money is going to pay for people who don’t. ( mind you, I don’t mind for legitimate recipients, Americans are the most generous people in the world).
The entire system needs to be revamped… reset. After an evaluation, every recipient should have to be made to reapply. There should be very strict guidelines… having 6 kids from 6 different baby daddies should not be a qualification, but sadly, there are women that make a career out of government benefits. The last video, was a Hispanic woman complaining because she had 10 kids…
If you can’t afford them, don’t have them… but those 10 kids will net her over $100,000 in government benefits. So why would she invest in condoms ? Are you getting it yet, its a long game scam.
I’m sorry, but my sympathy bone is broken… if you can’t comprehend what i’m saying or just don’t understand or are blind to it… do a quick facebook or a tiktok search… look up EBT , SNAP scams… watch the videos and tell me if you’re not sick to your stomach when you see a perfectly abled body female showing you a $6,000 balance on their government credit card… or you see these huge overweight individuals pulling 3 carts of groceries… 95% of it being sugar and junk food…
All the things the rest of us have to struggle for. It’s time for Americas Government to stop being the titty and be the belt.
When are non-elected Judges going to quit messing with the government that we, the people, elected to office to conduct the countries business???? It’s time to remove these judges for interfering with the government. Several idiot judges telling our government who represents the people is NOT right!!!!!!!
Thes rogue judges are the RUINATION ! The have NO fiscal, funding allocation authority, ONLY can dictate in their district ONLY, with NO national authority.
The President has Executive Orders authority for even funding that results, but Congress does the funding appropriations including those that result from Executive Orders.
And how many other financial situations will activist judges decide they can meddle in? That should have been a SCOTUS decision.
