ALEXANDRIA, Va. — A federal grand jury has again declined to issue a new indictment against Letitia James, shutting down — at least for now — the Justice Department’s effort to revive a mortgage-fraud case that has already been thrown out once in court.
The decision comes weeks after a federal judge dismissed the original October 2025 indictment, ruling that prosecutor Lindsey Halligan had been improperly appointed and therefore lacked the authority to bring the charges.
Prosecutors quickly re-presented the case to a new grand jury in Norfolk — an unusual step given how rarely grand jurors refuse prosecutors’ requests. Yet the panel declined to issue charges.
What Prosecutors Alleged
The Justice Department had accused James of misrepresenting the status of a Norfolk property she bought in 2020. According to investigators, she claimed the home would be used as a second residence but later rented it out, which allowed her to secure better mortgage terms and save roughly $18,000 to $19,000.
James has denied any wrongdoing. Her lawyers say the case is both politically driven and legally flawed. (They’ve argued the DOJ stretched a relatively small-dollar dispute into a federal case to satisfy political demands.)
Politics Around the Case
The prosecution effort has drawn attention because of pressure from President Donald Trump, who has publicly called for legal action against several political opponents, including James and former FBI Director James Comey.
The judge’s dismissal of the first indictment rested entirely on procedure, not the underlying facts. That left the door open for prosecutors to try again, but the grand jury’s latest decision suggests deeper skepticism about the case.

The Justice Department had no comment on the development. The U.S. Attorney’s office for Eastern District of Virginia did not immediately respond to a request for comment. The Hill also requested comment from James’s legal team and office.
What Comes Next
This second rejection doesn’t end the matter outright. Justice Department officials could try a third grand jury presentation or look for other legal avenues.
Still, the back-to-back refusals signal real resistance to the government’s strategy and raise questions about both the durability and the motivations of the prosecution.
