Former President Donald Trump’s lawyers filed a motion last night requesting Judge Tanya S. Chutkan be removed from his Jan. 6 case in Washington, D.C. In their recusal brief, attorney John Lauro alleged that Chutkan made prejudicial remarks in a different J6 case.
The brief contains an excerpt of Chutkan’s statements to rioter Robert Palmer, whom she sentenced to five years in prison for using a wooden plank and fire extinguisher to attack police officers.
The motion for recusal faces significant challenges, but that did not deter pundits from weighing in:
In response, Chutkan ordered a recusal motion briefing. She specified that the motion would not delay other deadlines set by the court.
Chutkan instructed the Department of Justice to file any opposition to the defendant’s motion “no later than September 14, 2023, and the defense shall file any reply within three calendar days from the filing date of the government’s opposition.”
She cautioned the defense to consult with opposing counsel before filing future motions “to indicate whether the motion is opposed.” Noncompliance may result in their dismissal “without prejudice.”
The federal case charging Trump with trying to illegally overturn the 2020 presidential election is set for March 4, 2024, one day before Super Tuesday.

Judge acts above the Law

There is no question Chutkan has made serious prejudicial remarks. It’s a matter of public record. Chukan May oppose being removed. But Trump’s attorneys are correct, her prejudicial remarks will call into question any decision that results from a trial she oversees. By those facts and standards ther is no question—she must be removed.
It will no doubt work it’s way up to the Supreme Court, where they will agree with Trump’s lawyers. Then there will be long delays in appointing a new judge and deciding on a new trial date.

I’m still waiting for disclosure on why this particular ‘judge’ was appointed for this trial. Who made this decision and what criteria did they use to decide? Did they not consider her previous prejudicial commentary. Hmm maybe that is exactly why she was chosen……………….
