California's lieutenant governor is hoping to take advantage of the Colorado Supreme Court's recent decision to ban former President Donald Trump from that state's primary ballot. On Wednesday, Lt. Gov. Eleni Kounalakis (D) wrote state Secretary of State Shirley Weber (D), urging her to explore all legal options to purge Trump from the 2024 ballot.
However, it appears that Kounalakis needs to brush up on her knowledge of the Constitution. In her enthusiasm, Kounalakis incorrectly stated that the minimum age limit for presidential candidates in 40. However, as stated in the Constitution, the minimum age requirement for eligibility to run for president is actually 35.
“The Constitution is clear. You must be 40 years old and not an insurrectionist,” Kounalakis original letter read. It has since been updated on the lieutenant governor's website.

The corrected letter is identical to the original outside of the correction. In it, Kounalakis requested that California State Secretary Shirley Weber follow Colorado's lead and pursue every possible option to remove Trump from California's ballot.
“I am prompted by the Colorado Supreme Court's recent ruling that former President Donald Trump is ineligible to appear on the state's ballot as a Presidential Candidate due to his role in inciting an insurrection in the U.S. Capitol on January 6, 2021,” it read. “This decision is about honoring the rule of law in our country and protecting the fundamental pillars of our democracy.”
The Colorado Supreme Court ruled on Tuesday that Trump is ineligible to run for president, arguing that he had taken part in an insurrection. The case is expected to go to the U.S. Supreme Court.
