Three Republican-led states are suing to stop the Biden administration from lifting the Trump-era Title 42 public health order.

The Centers for Disease Control and Prevention says that “current public health conditions and an increased availability of tools to fight COVID-19” make it possible to return to pre-pandemic immigration policies.
However, Arizona, Louisiana and Missouri’s attorney generals disagree and are fighting back.
As Fox News reports:
“This suit challenges an imminent, man-made, self-inflicted calamity: the abrupt elimination of the only safety valve preventing this administration’s disastrous border policies from devolving into an unmitigated catastrophe,” the complaint read.
“We want to stop the Biden administration from rescinding Title 42 because it may be one of the most boneheaded decisions of this administration, and they have done a lot of dumb things,” Arizona Attorney General Mark Brnovich said Monday morning on “FOX & Friends.” “I’m doing everything I can to hold the Biden administration accountable and stop them from destroying our southern border.”
The Biden administration announced on Friday that it will be terminating the order, despite fears of a massive migrant wave in the coming months. In February, 55% of the more than 164,000 migrants encountered at the border were expelled under the order.
Meanwhile, vulnerable Democrats are worried about the impact a migrant surge will have on their reelection hopes.
The Hill reported Monday that Sen. Raphael Warnock (Ga.) became the latest Democrat to criticize the administration’s announcement:
“I think this is not the right time and we have not seen a detailed plan from the administration. We need assurances that we have security at the border and that we protect communities on this side of the border,” he said. “I think this is the wrong time and I haven’t seen a plan that gives me comfort.”
