Former President Donald Trump and some of his co-defendants are appealing a ruling that allowed Fulton County District Attorney Fani Willis to continue prosecuting the Georgia election subversion case.
The defense attorneys on Friday asked the Georgia Court of Appeals to overturn Judge Scott McAfee's initial decision that allowed Willis and her office continue to pursue the case but only if her top prosecutor, Nathan Wade, resigned.
While Wade has since left the case, defense attorneys still want the appellate court to disqualify the entire Fulton County DA office.
After listening to arguments on whether or not Willis should be disqualified, Fulton County Superior Court Judge Scott McAfee ruled earlier this month that Willis could remain on the case but only if she fired special prosecutor Nathan Wade.
Wade subsequently recused himself from the case.
