Is this the end for Fox News? No, but it certainly portends terrible news.
Dominion Voting System’s defamation case against Fox News for allegedly giving credence to false allegations about the 2020 presidential election will proceed to trial.
The news comes after the presiding judge allowed a jury to decide whether Fox’s actions to suppress fact-checks and other evidence to refute claims by former President Donald Trump constitute actual malice.
Dominion’s case will go to trial in mid-April, after which a jury will decide if Fox is liable for defamation.
Thus far, court filings disclosed private messages by Fox personalities and executives, all the way to Tucker Carlson and Rupert Murdoch, that showed they privately trashed Trump’s allegations but were more frightened by the prospect of losing their audience. The remarkable, 130-page ruling from Delaware Superior Court Judge Eric M. Davis found that there was no need for a jury to establish that the broadcasts at issue were false.
“While the Court must view the record in the light most favorable to Fox, the record does not show a genuine issue of material fact as to falsity,” Davis wrote in his ruling. “Through its extensive proof, Dominion has met its burden of showing there is no genuine issue of material fact as to falsity. Fox therefore had the burden to show an issue of material fact existed in turn. Fox failed to meet its burden. The evidence developed in this civil proceeding demonstrates that is CRYSTAL clear that none of the Statements relating to Dominion about the 2020 election are true.” (emphasis in original)
Dominion heralded that aspect of the opinion in a statement.”
“We are gratified by the Court’s thorough ruling soundly rejecting all of Fox’s arguments and defenses, and finding as a matter of law that their statements about Dominion are false,” the company wrote in a statement. “We look forward to going to trial.”
Fox News’ lawyers attempted to rebuff Dominion’s lawsuit by arguing that Trump and his allies’ claims were newsworthy themselves.
However, Judge Davis rejected that and Fox’s other First Amendment defenses, citing, “Even if the neutral report privilege did apply, the evidence does not support that FNN conducted good-faith, disinterested reporting.”

Hopefully Dominion LOSES and gets SUED into POVERTY . . . along with the REST of their CEOs.
I can’t wait for this to backfire – discovery is a two edged sword and Dominion made a big mistake here.
