On Thursday, America First Legal filed a lawsuit against all 15 counties in Arizona, accusing them of failing to remove illegal immigrants from the state’s voter rolls.
America First Legal, a conservative legal organization focused on immigration issues, had initially sent letters to election officials in all 15 counties, demanding they uphold their legal obligations to prevent noncitizens from voting. The organization warned that if these obligations were not met, legal action would be taken on behalf of their clients.
The lawsuit initially targeted Maricopa County on behalf of the Strong Communities Foundation of Arizona and Yvonne Cahill, a naturalized U.S. citizen and voter. The claim is part of broader efforts similar to those in Virginia and Texas, where officials have worked to remove ineligible voters, including illegal immigrants, from voter rolls. America First Legal’s claims are based on Arizona state laws that require county recorders to perform monthly voter list maintenance to remove noncitizens from the voter rolls. However, Maricopa County removed the case to federal court, arguing that it also involves federal laws, which should be interpreted by a federal court.
In Arizona state court, only one county can be sued in cases like this. In federal court, however, plaintiffs can sue multiple counties at once. Now that the case is in federal court, America First Legal has added the other 14 counties to the lawsuit to ensure compliance with statutory duties across the entire state.

The U.S. Census, which determines congressional apportionment, counts all residents in the country, regardless of legal status. This means that areas with higher numbers of noncitizens, including illegal immigrants, may receive more representation in Congress due to their overall population size, even though noncitizens cannot vote.
Indeed, studies have shown that states with large immigrant populations, such as California, New York and Texas, do see increased representation in Congress due to the Census counting all residents, not just citizens. Critics argue that this dilutes the voting power of citizens in states with fewer immigrants.
Their presence in a state can shift the demographic balance, potentially influencing political agendas, policies and the allocation of federal resources.
In 2020, the Trump administration attempted to exclude illegal immigrants from the Census count for apportionment, arguing that it unfairly skewed political representation. However, the Supreme Court did not block the Census from including all residents, and the effort was ultimately unsuccessful.
