The U.S. Supreme Court rejected an emergency appeal to remove Robert F. Kennedy Jr. from the presidential ballot in Michigan and Wisconsin.
The Tuesday ruling keeps Kennedy on the ballot in the two critical swing states just days before Election Day.
Kennedy, who had originally been on the ballot due to his own Independent presidential campaign, argued that being kept on the ballot in these states infringed upon his First Amendment rights.

Michigan officials told the Supreme Court this week that over 1.5 million voters had already returned absentee ballots with Kennedy’s name listed as an option on them and that another 263,000 residents had voted early.
The court issued no detailed explanation for its decision to deny Kennedy’s appeal, though Justice Neil Gorsuch dissented in the Michigan case.
“This election is not merely ‘imminent,’ it is already underway, and voters are already voting,” Michigan officials had told the Supreme Court.
Kennedy has withdrawn from the ballot in other key battleground states, including Arizona, North Carolina and Nevada, and will not appear in other states like Florida, Ohio and Texas, CBS News reported. He missed qualification in New York and Georgia, with the Supreme Court denying his request to be reinstated in New York, and he chose not to appeal a Georgia court decision.
On Thursday morning, two new polls from Michigan showed Harris up by 1 percentage point (The Washington Post), while an MNS/Mitchell Research survey had Trump leading by 1 point. The latest RealClearPolitics polling average in Michigan shows Harris ahead by 0.5 points.
In Wisconsin, the latest survey from Marquette University has Harris leading by 1 point, while a CNN poll conducted from Oct. 23-28 shows Harris up by 6 points. The RealClearPolitics polling average in Wisconsin, including CNN’s survey, shows Harris ahead by 0.2 points.
Based on these numbers, RealClearPolitics predicts that former President Donald Trump will win the presidency with 287 electoral votes to Vice President Kamala Harris’ 251. However, turnout remains the most crucial factor.
