The Democratic commissioners of Bucks County, Pennsylvania, voted Thursday to permit the counting of undated and misdated ballots. The controversial decision comes as the state undergoes a recount in the Senate race between Democratic Sen. Bob Casey and Republican Sen.-elect Dave McCormick. Casey trails McCormick by 23,499 votes.
Commissioners Diane Ellis-Marseglia and Robert Harvie moved to allow the counting of these ballots in the pivotal swing county, despite a Pennsylvania Supreme Court ruling on Nov. 1 explicitly prohibiting such practices. Similar policies have been implemented in other Pennsylvania counties, including Centre, Philadelphia and Montgomery, where election officials have also opted to count ballots with date discrepancies.

While some attendees and participants in the meeting argued against counting undated or misdated ballots by citing case law, Ellis-Marseglia said that “precedent by a court doesn’t matter anymore in this country” because “people violate laws anytime they want.”
“For me, if I violate this law, it’s because I want a court to pay attention to it,” Marseglia-Ellis said.
The decision sparked immediate backlash from Republicans. McCormick and his allies filed lawsuits Thursday, challenging the county’s move to include potentially invalid ballots in the recount process.
Marc Elias, a high-profile Democratic election attorney tied to past controversies like the Steele Dossier, has joined efforts to contest the Senate race’s preliminary results. Elias has previously spearheaded legal battles aimed at validating problematic or disqualified ballots, including his involvement in the 2008 Minnesota Senate race. In that instance, Elias helped Democrat Al Franken secure a Senate seat by a 0.01% margin after an eight-month dispute, despite initially trailing Republican incumbent Norm Coleman by 215 votes.

The Bucks County decision follows another high-stakes election controversy. On Oct. 30, a Pennsylvania court sided with the Trump campaign, extending early voting hours in Bucks County after viral footage revealed poll workers prematurely closing a high-traffic voting location. The ruling ensured voters could access the polls in the crucial final days before the election deadline.
Bucks County has historically been regarded as a bellwether due to its tendency to reflect broader electoral outcomes. In recent years, it has become a swing county, with both Republicans and Democrats vying for its support. In the 2020 presidential election, Bucks County voted for Joe Biden, aligning with the state’s overall result. However, in the 2024, the county shifted to support Donald Trump, who won Pennsylvania.

Arrest them for openly violating a law by the Supreme court. The ballots they want to count were not properly filled out or they might be bogus ballots. Either way, they cannot be counted.
Why are these people not being removed? They are breaking the law and no one cares!
This criminal needs to be held accountable. Marseglia-Ellis deserves jail time and expulsion from her position, for encouraging lawlessness.
Madame Marseglia’s “interpretation of Law” and her “respect” for the highest court of Pennsylvamia are most interesting, THOUGH HIGHLY ILLEGAL if not to say “TREASONOUS”.
I suppose that there will be some consequence emerging – not so much from the mere interpretation but FROM THE CLEAR VIOLATION OF US ELECTION LAWS!
