The Republican National Committee (RNC) is considering legal action, including potential criminal charges, against Bucks County Commissioners Diane Ellis-Marseglia and Robert Harvie after they openly admitted to violating election laws by counting undated and misdated ballots in the Senate race between Republican Dave McCormick and Democratic incumbent Bob Casey. The controversy has ignited a fierce debate over election integrity, with the RNC accusing local officials of undermining the democratic process to benefit one party over the other.
The Bucks County commissioners’ decision to allow ballots that were undated or misdated to be counted came during a meeting on Thursday, November 8. The move has sparked widespread criticism, particularly from Republicans, who argue that it violates both state law and a recent Pennsylvania Supreme Court ruling. The court had determined on November 1 that ballots with missing or incorrect dates must be discarded, citing concerns over voter fraud and election integrity.
Despite this, Bucks County commissioners, as well as several other counties in Pennsylvania, have opted to include these controversial ballots in the ongoing recount for the Senate race. Republican candidate Dave McCormick, who was declared the winner by a narrow margin over Sen. Bob Casey, currently leads the race by over 17,000 votes.
“The fact that the margin is large enough that it will not be overturned does not take away from the fact that these are improper actions that are being taken by the Bob Casey campaign, by his attorneys, and by these officials,” Republican National Committee Chair (RNC) Michael Whatley said. He added that the RNC would continue to fight the inclusion of these ballots in court, regardless of the final outcome of the race.
The RNC immediately filed a lawsuit in response to the commissioners’ decision, suing all 67 county boards of elections in Pennsylvania to prevent undated or misdated ballots from being counted. The lawsuit aims to block the use of these ballots, which it claims are not compliant with state law. The RNC has also called for an investigation into what it considers to be “improper actions” by election officials in several other counties, including Centre, Philadelphia, and Montgomery counties, where similar decisions to count undated or misdated ballots have been made.
Ellis-Marseglia, one of the commissioners, dismissed concerns about the legality of the decision during the meeting, suggesting that “precedent by a court doesn’t matter anymore in this country” and that “people violate laws anytime they want.” These comments have raised alarm within the RNC, prompting Chairman Michael Whatley to issue a statement confirming that the party is considering criminal prosecution against the commissioners for their actions.
“We will pursue this to the fullest extent that we can,” Whatley told the Daily Caller during a Monday press call. “We’ve been very clear that we are going to prosecute to the fullest extent of the law, folks that are not following the law, that are trying to cheat in these elections.”
Wouldn’t it be justice if they treat Democrat hypocrites the same as they treated President Trump. Tie them up in court legality.
This is criminal contempt on the part of the election board if in fact what they did was in violation of Pennsylvania law. They should be prosecuted for their actions. I thought the Democrats only wanted valid votes to be counted (unless of course, the vote count was in favor of a Republican). Then it’s ok for them to violate the laws of the Commonwealth of Pennsylvania.

This illegal action only proves that the Democrat Party has placed itself above the law and will continue to act in such a manner regardless of court rulings not favoring democrats. The Democrats are acting in a dictatorial manner that they condemned President Trump for doing. The Democrats will do everything they can to interfere with the Trump administration as was done during the first Trump administration.
