An appellate judge from the Ninth Circuit recently dissented from his colleagues on Second Amendment matters. The U.S. Court of Appeals for the 9th Circuit recently upheld California’s ban on gun magazines that hold more than 10 rounds of ammunition.
So he made a lengthy video disassembling multiple firearms while explaining that the other judges have a “…basic misunderstanding of how firearms work.”
His video, as one might expect, immediately sparked flaming responses, including a lot of strong words from his colleagues and peers on other courts.
Dissent video in 23-55805 Duncan v. Bonta
United States Court of Appeals for the Ninth Circuit
Judge Lawrence VanDyke recorded an 18-minute video in which he said large-capacity magazines should be covered under the Second Amendment. “Large capacity magazines” and the often-reviled “high capacity magazines,” for all intents and purposes, are essentially standard capacity magazines. 30-round magazines are all ubiquitous except in areas where they are restricted by unconstitutional laws.
During his demonstration, VanDyke said he’d initially planned to voice his arguments in the dissent, but found it “…obviously much more effective to simply show you.”
Judge Lawrence VanDyke (born December 12, 1972) is an American lawyer and jurist serving since 2020 as a United States Circuit judge of the U.S. Court of Appeals for the Ninth Circuit. He previously served as the solicitor general of Nevada from 2015 to 2019 and of Montana from 2013 to 2014. Judge VanDyke was appointed to his position by President Donald Trump.

He got it right! EFF the other ones!
Apparently his fellow judges consider it an affront when he displayed to the world the depths of their ignorance.
Now he needs to make sure that not only the OTHER judges see this, but to make sure that the California Government a-holes see this. I also recommend that all also take firearms training and history of firearms. Something that most people don’t realize is that during the Revolutionary War, our soldiers used PERSONAL weapons, NOT government issued ones. Every soldier had his rifle or musket (yes, both were available) and a mold for the shot that fit their weapon(s). Government only provided gun powder and lead to the soldiers for their weapons. Hence, the 2nd Amendment! (The militia, meaning, the people!)
It is so refreshing to hear a sitting ninth circuit judge post a truth video regarding the idiotic ruling from the en banc panel of the Ninth Circuit. That group of asinine jurists that continuously abrogate the intent and purpose of the Bill of Rights with respect to the Second Amendment should actually be impeached and removed from the bench since they are so clearly anti-Constitutional. The swear to uphold the Constitution and then their actions demonstrate that they are willing to go to great lengths to insure that the Constitution is not of any concern to them, nor is its clear meaning based on the Founders commentary regarding its provisions of any concern to them. Heck, I doubt that many of them have even read the Constitution or the Bill of Rights, nor would they understand any of the Founders intent upon reflection of their commentary upon the subjects in those documents that they constructed and saw ratified by the several states of the union at the time, and also understood by those states that applied for and voluntarily became states in the United States since the ratification of the Constitution and Bill of Rights. Congress needs to assert its power to restrict the subservient courts and that includes the Ninth Circuit among others that are consistently abrogating the literal meaning of the Constitution and Bill of Rights in their convoluted, ridiculous rulings from their “august” benches. My feeling is that they should be removed from the bench and not allowed to be in any position to pass judgement about any issue since they are so clearly wrong and willing to be obstructionists and destroyers of the United States and its noble assertions in the Founders documents.
Just another commie clown from Calipornia gum flapping is all I see.
