Legal standoff raises questions about judicial authority and immigration policy execution.
A federal judge appointed by President Biden is drawing fire for what the Trump administration calls an “unprecedented defiance” of the U.S. Supreme Court.
On Monday, the high court ruled 6–3 in favor of reviving a Trump-era policy allowing expedited deportations of certain migrants to third countries — even if those countries aren’t their country of origin. The ruling paused a lower court injunction that had required migrants be given notice and a chance to raise torture-related concerns before removal.
But despite that clear ruling, Judge Brian Murphy, a Biden appointee, issued a fresh order on June 24, blocking the deportation of eight migrants currently held at a U.S. naval base in Djibouti. The group was scheduled for removal to South Sudan.
Murphy argued his May 21 order still stands and cited Justice Sonia Sotomayor’s dissent, which questioned whether the Supreme Court had jurisdiction to override his prior remedial orders — since the government hadn’t directly appealed them.

Per The Daily Caller:
Sotomayor suggested Murphy’s “remedial orders are not properly before this Court because the Government has not appealed them, nor sought a stay pending a forthcoming appeal.”
“All eight individuals—none of whom have final removal orders to South Sudan—are being deprived of basic procedural rights and access to protection that Congress and the Constitution require,” the migrants told Murphy in their Monday night filing. “Absent injunctive relief, these class members face imminent risk of deportation to a volatile country where they likely will face indefinite detention and other forms of torture.”
The Trump administration fired back, accusing Judge Murphy of undermining U.S. foreign policy and obstructing lawful deportations. In a Tuesday morning filing, Solicitor General John Sauer blasted the ruling as a direct challenge to Supreme Court authority, warning it could jeopardize delicate diplomatic efforts abroad.
“The district court’s ruling of last night is a lawless act of defiance that, once again, disrupts sensitive diplomatic relations and slams the brakes on the Executive’s lawful efforts to effectuate third-country removals,” Sauer wrote in a blunt message to the justices.
“For over two months now, the Executive has labored under an injunction that this Court yesterday deemed unenforceable,” Sauer continued. “This Court should immediately make clear that the district court’s enforcement order has no effect, and put a swift end to the ongoing irreparable harm to the Executive Branch and its agents, who remain under baseless threat of contempt as they are forced to house dangerous criminal aliens at a military base in the Horn of Africa that now lies on the borders of a regional conflict.”
As The Daily Caller reports, White House Deputy Chief of Staff Stephen Miller appeared on Hannity Monday night to defend the administration’s position, telling viewers to “expect fireworks tomorrow as we hold this judge accountable for refusing to obey the Supreme Court.”
