Newly obtained federal documents reveal that the Biden administration’s Department of Justice actively sought legal justification to investigate and potentially prosecute parents who protested school policies related to COVID-19 mandates, gender ideology, and critical race theory — despite strong warnings from career DOJ attorneys that such actions lacked legal basis and would trample First Amendment rights.
The documents, released by America First Legal (AFL), paint a picture of a coordinated, politically charged effort between the Biden White House and DOJ leadership to suppress parental dissent under the guise of addressing threats and harassment at school board meetings.
“These never-before-seen documents—uncovered only because of AFL’s relentless efforts over the past three and a half years—expose not only the Biden White House’s involvement in pushing a weaponized DOJ, but also strong dissent from careers within the Department’s Civil Rights Division,” the group said in a statement.
White House Pressure and DOJ Pushback
The trove of internal correspondence shows the DOJ scrambling to find a “federal hook” to intervene in what were largely local matters. In an email dated October 1, 2021, Kevin Chambers, an aide to then-Attorney General Merrick Garland, wrote: “We’re aware; the challenge here is finding a federal hook. But WH [White House] has been in touch about whether we can assist in some form or fashion.”
Only days later, on October 4, Garland issued a memo directing the FBI to work with local law enforcement in response to a “disturbing spike” in threats and harassment targeting school officials — a move based on a controversial letter from the National School Boards Association (NSBA), which suggested treating some protesting parents as potential “domestic terrorists.” That letter was later retracted.
The documents also reveal resistance from within the DOJ. One career attorney warned in an October 3 email: “I read the letter from NSBA, and looked at the links for a handful of footnotes, and it appears to me that the vast, vast majority of the behavior cited cannot be reached by federal law… Almost all the language used is protected by the First Amendment… So it seems we are ramping up an awful lot of federal manpower for what is currently non-federal conduct.”
Despite these internal warnings, the DOJ moved ahead with Garland’s directive, resulting in dozens of FBI investigations into parents — many of which, according to whistleblower reports in 2022, amounted to little more than political speech or local disruption.
Political Motives and Fallout
Critics now argue the documents confirm longstanding suspicions that the Biden DOJ was used as a political tool to chill dissent, particularly during the hotly contested Virginia gubernatorial race in late 2021.
“The Biden Administration appears to have engaged in a conspiracy that was ultimately aimed at depriving parents of two fundamental rights — the right to speak, and the right to direct the upbringing of their children,” said Gene Hamilton, president of America First Legal. “They did so with political intentions, most immediately by attempting to influence the Virginia gubernatorial election, and to more broadly chill dissent across the United States.”
Indeed, Virginia made national headlines for parent-led protests during that time, especially over issues like mask mandates and controversial curriculum changes. The political momentum from those protests was widely seen as pivotal in Republican Glenn Youngkin’s victory over Democrat Terry McAuliffe.
DOJ Independence in Question
Throughout numerous congressional hearings, Attorney General Merrick Garland has maintained that the DOJ operated independently from the White House and was not politically influenced. However, the emails released by AFL appear to directly contradict those claims, showing that White House officials were in communication with DOJ aides even before Garland’s memo was issued.
In one damning example, the Office of the Director of the Presidential Daily Briefing (PDB) at ODNI delayed the publication of intelligence assessments regarding foreign election interference under pressure from senior Obama-era officials — suggesting a pattern of politicization of federal agencies.
Broader Implications
The revelation is likely to rally new calls for accountability from Republican lawmakers and civil liberties advocates. With many Americans still reeling from pandemic-era policies, this latest development lends new credibility to years-old concerns.
As investigations continue and more documents are expected to surface, the Biden administration may face increasing scrutiny over its handling of dissent — and whether its Justice Department crossed constitutional lines in pursuit of political objectives.
