A New York judge has dismissed two terrorism-related charges against Luigi Mangione, scaling back — but not ending — the criminal case tied to the December 2024 assassination of UnitedHealthcare CEO Brian Thompson.
Terrorism Charges Dismissed
Judge Gregory Carro, appointed by former GOP Gov. George Pataki, tossed the terrorism enhancements in the state case.

Carro found that prosecutors failed to meet the high bar required under New York law. Specifically, they did not prove Mangione intended to “intimidate or coerce a civilian population” — a key element for charges under the state’s terrorism statute.
Core Murder Charge Remains
Mangione still faces a second-degree murder charge under state law. He has pleaded not guilty.
Pretrial hearings on that charge are scheduled for Dec. 1, 2025.
Federal Death Penalty Case Still Active
Meanwhile, federal prosecutors are continuing their own case, which includes charges that carry the possibility of the death penalty. The federal case remains active and poses the most serious legal threat to Mangione.
His defense team has raised double jeopardy concerns, arguing that simultaneous prosecutions by both state and federal authorities may violate constitutional protections. So far, courts have not accepted that argument, and the remaining charges remain in place.

Judge Gregory Carro is not fit to preside over this case move to strike and have him removed from this case. File an appeal for a new Judge to preside over the trial. After what this man did and the country just experienced, give the appearance of trying to incite even more violence directed at the Judiciary. This is insane. These Judges need to forced to carry malpractice insurance and should be subject just like any professional to Judicial Ethics Commission Review and possible civil law suit for misapplication of the law.
