The months-long back-and-forth involving illegal immigrant Kilmar Abrego Garcia has come to a close after a judge denied Abrego Garcia’s last bid to reopen his 2019 asylum case.

Abrego Garcia, a Salvadoran national who entered the United States illegally as a teenager, has lived for years in Maryland with his American wife and U.S.-born children. Despite building a life here, his legal status remained unresolved — a situation increasingly common as border security and immigration enforcement remain under strain.

In 2019, Abrego Garcia was arrested by immigration authorities and sought asylum, but he was ruled ineligible because he failed to file within the required one-year deadline — a key safeguard meant to ensure that asylum claims are timely and verifiable. A federal immigration judge nevertheless blocked his deportation to El Salvador, citing credible fears that violent gangs — which have destabilized parts of Central America and fueled illegal migration — would target him and his family.

However, in March, U.S. officials mistakenly deported Abrego Garcia to El Salvador, where he was briefly imprisoned under harsh conditions. The case became a rallying cry among activists opposed to President Donald Trump’s immigration enforcement policies, who argued that returning him to El Salvador put his life at risk. Yet for many Americans concerned about border control, the case underscored how chaotic and overburdened the immigration system has become.

After facing pressure and a looming Supreme Court review, the Trump administration returned Abrego Garcia to the United States in June — but he was promptly charged with human smuggling based on evidence from a 2022 traffic stop in Tennessee. U.S. Immigration and Customs Enforcement (ICE) is now pursuing removal to a third country, reportedly proposing Uganda and later Eswatini, though his lawyers argue these efforts are retaliatory.

Meanwhile, Abrego Garcia’s attorneys insist that the smuggling accusations are politically motivated and designed to punish him for resisting deportation during the Trump era.

Abrego Garcia has 30 days to appeal to the Board of Immigration Appeals.
