A federal judge has ruled that the Bureau of Prisons (BOP) must provide sex change procedures to a convicted pedophile who recently began identifying as transgender, according to court filings reported by Reduxx and The Post Millennial.
Brian Buckingham, 47, is currently serving a 21-year sentence for sexually abusing his 10-year-old son and producing child sexual abuse material. Shortly before his sentencing, Buckingham began identifying as a woman under the name “Nani Love” and claimed to suffer from gender dysphoria.
In filings to the court, Buckingham’s attorneys argued that the BOP’s refusal to provide “gender-affirming” treatments—including hormone therapy and surgery—had worsened Buckingham’s depression and suicidal thoughts. They contended that these treatments were “medically necessary” and that denying them violated Buckingham’s Eighth Amendment rights against cruel and unusual punishment.
Court’s Ruling
In September, Magistrate Judge David Christel found that Buckingham was “likely to succeed” on the claim that the BOP’s denial of sex change procedures constituted cruel and unusual punishment. The judge cited evidence showing that the BOP had initially acknowledged Buckingham’s requests for transition-related treatments but later “discontinued them without reason.”
Christel’s recommendation was subsequently adopted by U.S. District Judge Ricardo Martinez, who ordered the BOP to provide Buckingham with consultations for laser hair removal, facial feminization surgery, and voice therapy within 30 days.
Bureau of Prisons’ Response
The Bureau of Prisons objected to the ruling, urging the court to dismiss or delay the case until a final decision is issued in Kingdom v. Trump, a separate class-action lawsuit brought by transgender-identifying inmates. That case challenges the Trump administration’s restrictions on the use of taxpayer-funded sex change drugs and surgeries in federal prisons.
Buckingham’s lawyers opposed the delay, asserting that the inmate faced “irreparable harm” without immediate access to transition procedures.
Background of the Case
According to the reports, Buckingham—formerly involved in suicide prevention efforts for the Makah Indian Nation—was arrested after a 2020 investigation that began on Discord, where moderators flagged child sexual abuse imagery linked to his account. Authorities later discovered explicit videos featuring his son, leading to Buckingham’s conviction on multiple federal counts.
Buckingham’s legal team maintains that their client is entitled to complete access to gender transition treatments while incarcerated at FCI Butner in North Carolina.
Ongoing Controversy
The case has drawn sharp criticism from observers who argue that convicted child sex offenders should not receive taxpayer-funded surgeries while in prison. Supporters of the ruling, however, say it upholds constitutional protections for all inmates and ensures that medical needs related to gender dysphoria are treated with the same seriousness as other health conditions.

Yeah…. don’t think that is basic required medical attention. Maybe if he has the money to pay for it himself and the followups/meds/etc needed for the rest of the transition. But taxpayers paying for elective surgery like this is a NO GO!!!

This is the most outrageous thing I’ve heard this week, outside of Mandami winning the Mayoral election in NYC & Prop 50 passing in California. It’s obvious to me that the world is falling apart & massive cheating is going on everywhere.
