The Babylon Bee, the popular conservative satirical news outlet, secured a major First Amendment win on Friday thanks to the legal support of Alliance Defending Freedom (ADF).
A federal court struck down a Hawaii law signed by Democrat Gov. Josh Green in 2024 that criminalized the “reckless distribution… [of] materially deceptive media.” The law was justified by state lawmakers as a way to prevent content that could allegedly mislead voters or influence elections.
Under the statute, content that might harm “the reputation or electoral prospects of a candidate” or even “change… voting behavior” could be restricted — a sweeping standard critics argued posed a direct threat to political speech.
The law also required videos, audio, and images to carry government-mandated disclaimers displayed in a “clear and legible manner.” ADF argued that forcing satirical outlets like The Babylon Bee to label jokes undermines the very purpose of comedy and political commentary.
Violators could have faced jail time, fines, or lawsuits.
The legislation was aimed largely at AI-generated content — including parody images and media frequently used by the Bee.
“The legislature finds that although artificial intelligence (AI) technology can greatly benefit certain aspects of society, it can also have dangerous consequences if applied maliciously,” the bill stated. “For example, the use of deepfakes or generative AI in elections can be a powerful tool used to spread disinformation and misinformation, which can increase political tensions and result in electoral-related conflict and violence.”
Supporters of free expression celebrated the court’s decision as a blow against government overreach.
“This decision marks yet another victory for the First Amendment and for anyone who values the right to speak freely on political matters without government interference,” Babylon Bee CEO Seth Dillon said.
“We are grateful to Alliance Defending Freedom for representing us as we continue to challenge laws that treat comedy like a crime,” he added.
The Babylon Bee has grown into one of the most influential conservative voices in satire, gaining a massive following for its sharp commentary on politics and pop culture. The outlet now boasts more than 2 million followers on Instagram and 5 million on X.
