A top conservative think tank is vowing to make it “extraordinarily difficult” for Democrats to replace an ailing President Biden should he chose to step down.
They plan to do so by filing lawsuits in states where switching to another candidate on the ballot could pose a significant challenge for Democrats.
According to Fox News, The Heritage Foundation is actively preparing election legal challenges in multiple states should Biden forgo reelection. The strategy aims to restrict Biden’s removal from the ballot, adding a layer of uncertainty to the Democratic Party’s potential contingency plans. “We are monitoring the calls from across the country for President Biden to step aside, either now or before the election, and have concluded that the process for substitution and withdrawal is very complicated,” said Mike Howell, executive director of The Heritage Foundation’s Oversight Project. “We will remain vigilant that appropriate election integrity procedures are followed.”
Potential Legal Challenges and State-Specific Rules
In a separate statement, the Oversight Project warned: “If the Biden family decides that President Biden will not run for re-election, the mechanisms for replacing him on ballots vary by state. There is the potential for pre-election litigation in some states that would make the process difficult and perhaps unsuccessful.”
Heritage argues that many states – including the swing states of Georgia, Nevada and Wisconsin – have statutes that might prevent Biden from withdrawing his name as a candidate. Each state has its own set of rules when it comes to dropping out of the race, some stricter than others. At the same time, a handful have no standard operating procedure.
