Biden Asks Supreme Court to Let Stand Ruling That Samoans and Puerto Ricans are ‘Alien Race’ Unfit for Citizenship

The is asking the U.S. to let stand a series of 120-year-old federal court rulings, universally condemned as racist, that natives of American Samoa and other islands are an “alien race” unfit to become U.S. citizens.

Biden's Solicitor General, Elizabeth B. Prelogar, is demanding the Supreme Court not hear Fitisemanu v. , a case filed by three American Samoans challenging a series of federal court decisions handed down between 1901 and 1904 denying them automatic U.S. citizenship to residents of territories won in the Spanish-American War.

Those rulings, known as the , held that island natives, such as Samoans, were an “alien race” unfit for citizenship.

Under those rulings, “American Samoans are U.S. nationals but not citizens, preventing them from voting in state and federal elections even when they become residents of a state. Natives of other territories are U.S. citizens who can exercise all constitutional rights provided they first move to a state,” The Hill reports.

The Insular Cases appear to be much like Roe v. Wade, where even many advocates of legalized agreed the case should be overturned as it has been improperly decided.

Supreme Court justices across the board have condemned the Insular Cases as being improperly decided on the basis of race rather than legal or constitutional grounds, with conservative Neil Gorsuch writing last year, “The Insular Cases have no foundation in the Constitution and rest instead on racial stereotypes” and “the time has come to recognize that the Insular Cases rest on a rotten foundation. And I hope the day comes soon when the Court squarely overrules them.”

The Court will decide this fall whether to hear Fitisemanu.

  2. American Samoans are Americans and deserve citizenship. To deny them the rights and privileges of citizens when they pay taxes and obey our laws is racist, classless, and outdated. The same goes for Puerto Ricans!

  3. What can one expect? Pelosi and her drunken old man own a fish cannery in American Samoa. When a vote was taken to increase the minimum wage Pelosi had American Samoa specifically exempt from that law. No doubt she and Biden just want that old bitch to keep making more money. Puerto Rico is a bit of a surprise, though because that place is reportedly a hotbed of so called democrats. Perhaps they just got fed up with Biden’s BS.
