Congressman Starts Process Of Removing Biden From Office Under 25th Amendment

In a move that puts pressure on Vice President Kamala Harris and the presidential Cabinet to invoke a constitutional amendment allowing President Joe Biden to be quickly and legally removed from office.

Congressman Chip Roy (R-TX) filed H.Res.1336, a resolution “calling on Vice President Kamala Harris to convene the Cabinet and declare President Joe Biden as unable to carry out his duties as Commander-in-Chief.”

 “I put forth a resolution calling upon the Vice President to immediately use her powers under section 4 of the 25th Amendment to convene and mobilize the principal officers of the Cabinet to declare the President of the United States is unable to successfully discharge the duties and powers of his office,” said Roy.

The 25^th Amendment lays out a process by which the President of the United States can removed from office 

Under the amendment, if the Vice President and a majority of the President’s Cabinet issue a written statement to Congress declaring the President “is unable to discharge the powers and duties of his office,” the Vice President becomes acting president for four days.  If during that four day period the President does not challenge the declaration the President is removed from office.

If the President declares he or she is able to perform his or her duties, the Vice President and a majority of the President’s Cabinet could issue a second written statement to Congress declaring the president is, in fact, unable to perform his or her duties.

Then, within 21 days of receiving the second declaration, two-thirds of both houses of Congress can vote to declare the president is unable to perform his duties, and permanently remove him or her from office.

Roy’s resolution comes after an increasing number of high-level Democrats have called on Biden to drop his re-election bid amid fears he is suffering from cognitive decline and will lose to Republican nominee former President Donald Trump.
