A federal judge is blocking the deportation of Kilmar Abrego Garcia — for now.
Judge Paula Xinis, appointed by President Barack Obama in 2014, told Justice Department attorney Drew Ensign that the Trump administration is “absolutely forbidden at this juncture” from removing Abrego Garcia from the continental United States, according to Politico reporter Kyle Cheney.
Abrego, an illegal immigrant, had been granted a protection order back in 2019. Despite that, he was mistakenly deported to El Salvador in March 2025. After discovering the error, Xinis ordered his return to the U.S. and called the government’s actions “lawless,” even with Abrego’s alleged gang affiliation.
Xinis has consistently criticized the administration’s handling of the case, using that earlier court order to push back against what she sees as an unjust enforcement policy.
In today’s hearing, she followed up by barring authorities from transferring Abrego out of his Virginia detention facility. The goal: to ensure he has continued access to legal counsel.
In a testy exchange, Xinis asked whether her oral order alone was sufficient. Ensign — who in the past insisted only written orders count — confirmed it would be.
Abrego crossed the U.S. border illegally and has remained entangled in a lengthy legal battle since this spring. His status is still unresolved, and the fight over his future in the U.S. shows no sign of ending anytime soon.
