President Donald Trump is expected to sign an executive order today cracking down on individuals who desecrate the American flag, including by burning it, according to an exclusive report from Fox News Digital.
The executive action—part of a broader campaign to restore patriotism and reinforce national unity—will mandate prosecution of those who violate existing laws in ways that involve flag desecration. It also directs the Department of Justice to pursue litigation that could test and clarify the limits of First Amendment protections around flag-burning.
“The American flag is the most sacred and cherished symbol of the United States of America,” reads a fact sheet on the order. “Desecrating it is uniquely and inherently offensive and provocative… and an act used by groups of foreign nationals calculated to intimidate and threaten violence against Americans.”
Key Provisions of the Executive Order
- Mandates prosecution of flag desecration under applicable federal, state, and local laws.
- Directs Attorney General Pam Bondi to refer cases to local authorities where necessary.
- Orders the Departments of Justice and Homeland Security to revoke visas and other immigration benefits from non-citizens found to have desecrated the flag.
- Encourages litigation to clarify how far free speech rights extend when it comes to the American flag.
Recent Incidents Prompting the Action
The order follows a series of high-profile protests where the American flag was burned, spit on, or trampled, especially during recent anti-Israel demonstrations, immigration raids, and campus protests.
Incidents cited include:
- Flag burning outside the Democratic National Convention in Chicago in August 2024.
- A similar protest in Washington, D.C., in July during Israeli Prime Minister Benjamin Netanyahu’s address to Congress.
- A Fourth of July protest in New York City, where demonstrators torched American flags while protesting American support for Israel.
- A flag-burning incident in Los Angeles, where protesters waved Mexican flags in response to immigration enforcement raids.
Video clips from these events—some of which went viral—depict protesters setting fire to flags, spitting on them, and calling for the downfall of the U.S. government. One protester in L.A. was quoted shouting, “This is not just a gesture, this is something we need to make real. We need to take down this empire once and for all.”
Legal and Political Backdrop
While flag desecration is deeply offensive to many Americans, the Supreme Court has previously ruled such acts are protected free speech under the First Amendment. Trump’s executive order is expected to challenge or clarify that precedent by directing the DOJ to pursue relevant legal avenues.
Critics—including “civil liberties” advocates and some legal scholars—warn the move could reignite constitutional battles, especially around symbolic speech. But the administration argues that national security, public order, and immigration enforcement give the government a compelling interest in taking action.
A Broader Patriotic Push
This executive order follows other actions from the Trump administration meant to elevate national symbols and values, including a ban on foreign or political flags (such as the Pride flag) from being flown at U.S. embassies or consulates and the installation of two 88-foot-tall American flags at the White House — a personal project funded by President Trump himself, according to aides.
“This is just one of many projects President Trump selflessly paid for to make the White House even more patriotic and beautiful,” said White House spokesperson Davis Ingle.
The Political Impact
While Trump’s base has long supported stricter enforcement against flag-burning, the order is expected to draw legal scrutiny and media backlash, especially from progressive groups.
However, for many conservatives and independents, the action may resonate. Flag desecration has been a cultural flashpoint for decades, seen by many not simply as protest, but as deliberate disrespect for the country and its values.
The executive order is likely to lead the national conversation—galvanizing Trump’s supporters and challenging political opponents to respond to the question: Where do you draw the line on patriotism and protest?

About time we demanded respect for this country.
The destruction of this country by Corrupt Globalist Establishment Elites has to stop/
It’s about time!
Thank God for a President that truly loves this country and what it stands for. Try pulling these type of antics in countries like N. Korea, China or Iran and see what it gets you. You wouldn’t have to worry about being arrested for a crime. Instead you would just be picked up off the street our out of your residence with no explanation of why. Then you would probably be tortured and then beheaded, shot or hanged without any rights to claim you had rights. We are not a totalitarian government but we should have laws that prevent sacrilege being done to our national symbols. I remember as a boy in the Boy Scouts and as an officer in the Army National Guard that we were taught that if we accidently let the flag touch the ground that before it could be used again it had to be inspected for damage. If there was damage then if it could be repaired by cleaning or by sewing small tears, then it could be reused. If it couldn’t, then it was retired and destroyed in a respectful ceremony. That we give anyone, especially non-citizens that are in our country as guests, a pass on having to respect one of our national symbols byway of the 1st Amendment is an egregious interpretation of what the 1st Amendment was intended to do.
I always appreciate Seijah Drakes reporting. Thank you.
The woke, liberals, socialist regime has destroyed and twisted all the good this country stands for. Thank God for President Trump for being a true patriot and loves this country very much. As far as the 1st amendment is concerned, it can never be an option whether the burning of the American flag is free speech as it is only a symbol of hate, destroying what this country stands for. If we use the 1st amendment for other things then why is it not permitted to burn other flags like the LGBTQ, BLM, or another countries flag? Answer is simple as those left-wing bias creeps think it is hateful to burn but in the same breath calls all anti-American things free speech. To put it simply their agenda is BS.
