A federal appellate court has temporarily reinstated President Donald Trump’s “Liberation Day” tariffs, halting yesterday’s ruling by the U.S. Court of International Trade (CIT) that had declared the tariffs unlawful. The appellate decision allows the tariffs to remain in effect while the Trump administration appeals the CIT’s ruling.
The original CIT decision found that President Trump had overstepped his authority by using the 1977 International Emergency Economic Powers Act (IEEPA) to impose sweeping tariffs without congressional approval. The court concluded that the IEEPA does not grant the president the power to unilaterally impose such broad tariffs, and it permanently enjoined the enforcement of the “Liberation Day” tariffs.
Later Thursday afternoon, a second federal court in Washington, D.C., also rebuked Trump’s use of tariffs. In response, the White House filed emergency motions to stay both rulings and signaled plans to appeal to the Supreme Court, possibly as soon as Friday.
But the U.S. Court of Appeals for the Federal Circuit quickly interjected, lifting the first of two rulings that had blocked some of Trump’s tariffs. The move handed the president a temporary win shortly after a second lower court rejected the administration’s legal defense. However, the reprieve does not affect the separate injunction issued by the D.C. court.
The appellate court’s stay introduces further uncertainty into U.S. trade policy, as legal proceedings continue. According to Axios, the Trump administration is fully committed to pursuing the case to the Supreme Court if necessary:

The world has been screwing us for decades and our namby pamby Congress has been paid off one by one to let everyone take a bigger and bigger bite out of our preverbably hind ends. Are we not the most powerful, more industrialized, most free nation in the world or did we give that up to DEI and LGBTQALKDLNFLNFFEONRF so the fell good at our expense. Come on grow some balls and boogs and start acting like American Adults.
These judges who appear to NOT know the law in spite of their “proudly” wearing the signature black robes, , need to stop believing hat they know diddly squat about running the country

These robed wonders need to get back to their “case load,” assuming they know what that is, and allow the experts to do what they were elected to do – RUN the country – WITHOUT their interference.
