DeSantis Lawsuit Blocks Biden From Releasing Migrants Without Court Dates

Hours before the end of , last-minute legal action brought by Gov. ' administration stopped the Department of Homeland Security () from releasing illegal immigrants without court dates.

Fox News reports:

Judge T. Kent Wetherell II imposed a two-week restraining order on the policy, which would see migrants released on “parole with conditions.”

The policy was outlined in a Border Patrol memo this week, which says that migrants can be allowed into the country on parole — a process typically reserved for “urgent humanitarian reasons or significant public benefit” — if (CBP) faces overcrowding. The memo calls the practice “parole with conditions” as migrants are required to make an appointment with Immigration and Customs Enforcement (ICE) or request a Notice to Appear by mail.

Under a parole release, migrants are rapidly released into the country, do not get an alien registration number and do not receive a court date.  

The use of parole is being authorized if a sector capacity goes above 125%, if agents apprehend 7,000 a day over 72 hours or if average time in custody goes above 60 hours. Agents have been encountering over 10,000 migrants a day since Monday, and there are no signs of that slowing down with the looming end of Title 42, which is expected to bring an even bigger wave with it.

officials and border state governors had sounded the alarm on the decision to end Title 42, a pandemic immigration policy that expelled more than 2.5 million migrants.

Florida Sheriff's Association President Al Nienhuis praised DeSantis' actions Thursday, one day after DeSantis signed a sweeping immigration bill that will mandate E-Verify for employment and no longer recognize driver's licenses issued to illegal immigrants by other states.

“Where's this president's energy? Where's his vigor? Where's his commitment to the cause? He's just sitting around doing nothing of importance or nothing of note while the American people suffer,” DeSantis exclaimed Wednesday.

  1. Good for DeSantis. He seems to be trying hard to help Americans. He’s got a tough row to hoe going against the Demokrat WH resident, but he’s doing great so far.

  2. I am thankful for Governors Abbott and DeSantis. They are stepping up to do the job that the worthless, anti-American Biden administration should be doing.

  3. Unfortunately just giving them a court date – which very few will actually at – only delays the problem. I don’t have any better of a solution since it is apparently not a case of simply sending them back. Hmm perhaps if there was a secure border to keep them out in the first place we wouldn’t have this problem.

    • We had a President who did his very best to secure our borders and his efforts were received with criticism, taunts, called a racist, accused of discrimination, treated horribly, lied about, and deceived by some in his own party (RINOS). Just look at this costly, pathetic mess the Democrats and their conspirators have caused, yet 37% of the half-wits still support this POS.

    • My suggestion, for more than a decade, has been for the military to purchase as strip of land on the border and use it as a live fire training area. The sign on the wall could read “Live fire training area. Violators remains will be cremated if found.”

  6. Issue them a court date, no problem, but how many will ignore their court date and just disappear into the woodwork? This is my fear, for there are many new illegals, not just from Latin America, but from three dozen other nations, some of which hate our guts and have sent goons across our border to establish or support sleeper cells. But the DemoCreeps want to establish a permanent underclass of voters who can be bribed with ‘free stuff’ to vote Democrat. And the Globalists are keen on deconstructing national boundaries. We the People cannot win.

  7. Under Federal law, it is illegal to release them into the US, PERIOD. The law specifically requires the remain in custody, or are removed from the US until the court date.
