A federal judge has ordered the Trump administration to immediately resettle some 12,000 refugees into the United States.
U.S. District Judge Jamal Whitehead, a Biden appointee, issued the order despite the Trump administration saying during a hearing last week it would likely appeal any order requiring thousands to be admitted.
“This Court will not entertain the Government’s result-oriented rewriting of a judicial order that clearly says what it says,” Whitehead wrote. “The Government is free, of course, to seek further clarification from the Ninth Circuit. But the Government is not free to disobey statutory and constitutional law — and the direct orders of this Court and the Ninth Circuit — while it seeks such clarification.”
Trump signed an executive order on his first day in office suspending refugee resettlement and ordering the Department of Homeland Security to report back in 90 days on whether resuming resettlement would be in the interests of the U.S.
The order was one of a number of orders attempting to limit both illegal and legal immigration, including the use of parole to allow in migrants by the Biden administration. Trump had limited refugee resettlement in his first term, but President Joe Biden made moves to take in more refugees, including by increasing the refugee cap.
“The United States lacks the ability to absorb large numbers of migrants, and in particular, refugees, into its communities in a manner that does not compromise the availability of resources for Americans, that protects their safety and security, and that ensures the appropriate assimilation of refugees,” Trump said in his Jan 20 order.
“This order suspends the USRAP until such time as the further entry into the United States of refugees aligns with the interests of the United States.”
In February, Whitehead blocked the Trump administration’s move to suspend refugee admissions into the United States in response to a lawsuit from several refugee aid groups, ordering the Trump administration to resume processing the cases of refugees who are protected by the court order.
The federal judge also told the government to immediately take steps to facilitate admission to the U.S. for those refugees whose clearances, including medical and security authorizations, have not yet lapsed.

It definitely appears to me that the Judicial Branch has declared itself the Only blench in the government, absorbing the the Executive and Legislative Branches, and putting the Supreme Count in its pocket for added protection and collaboration.
