Supreme Court Rules On Trump’s Claims Of Presidential Immunity

The Supreme Court is officially unwilling to allow states, starting with , to use Section 3 of the to keep Trump off the ballot.

The 9-0 ruling puts an end to state challenges that sought to disqualify Trump for his alleged actions leading up to and during the U.S. Capitol riot.

The only way to defeat the presumptive Republican nominee's bid for a nonconsecutive second term? Beat him at the ballot box.

In its majority opinion, the court wrote “the Constitution makes , rather than the States, responsible for enforcing [the 14th Amendment] against federal officeholders and candidates.”

Trump asked the U.S. Supreme Court to overturn a Colorado Supreme Court ruling that disqualified him from the state's ballot under section three of the 14th Amendment, which prohibits people from holding public office who have taken an oath of office and then “engaged in insurrection or rebellion against the [U.S.], or given aid or comfort to the enemies thereof.”

Colorado was the first state to kick Trump off the ballot as lawsuits have proliferated across the country challenging his candidacy, with Maine and Illinois following, but the court's ruling Monday kills those cases, as justices unilaterally found that states cannot remove federal candidates from the ballot.

In a concurring opinion, liberal Justices Sonia Sotomayor, Elena Kagan and Ketanji Brown Jackson wrote that upholding the Colorado ruling would “create a chaotic state-by-state patchwork,” but opposed part of the majority's opinion that said Congress has to pass a certain kind of legislation in order to disqualify office holders.

Justices suggested at oral arguments in February they were likely to keep Trump on the ballot, with even liberal justices signaling they didn't believe states had the power to disqualify Trump.

Trump praised the ruling on social , posting on his account, “BIG WIN FOR AMERICA!!!”
