New York Enacts New Gun Laws Despite Legal Challenges

Thursday marked the first day that new gun laws in state went into effect.

New York was forced to reexamine their previous gun laws in the wake of the -backed NYSRPA v. Bruen decision handed down in June.

Following that decision, Governor called a special session of the state legislature. Lawmakers used that session to pass new conceal carry regulations and worked to address what they often call the “epidemic of gun violence” — borrowing a phrase from fellow Democrats such as President Biden.

Frank Miniter, Editor in Chief of the NRA's publication America's First Freedom wrote that by passing its new law, “New York, however, has decided lawful armed citizens are the problem. Officials have now used crimes committed by those who are not lawfully carrying to justify this infringement on good citizens.”

Several pro- groups have challenged the state's new gun laws, which they still believe are too restrictive.

Gun Owners of America shared earlier today that their injunction against the state's new “draconian concealed carry law” was denied.

According to GOA, the New York law puts new restrictions on those applying for a concealed carry permit. Applicants will now be required to do the following:

  • Display “good moral character”
  • Disclose their social accounts for review
  • Have in-person interviews with
  • Provide four “character references”
  • Undergo 18 hours of combined training, a tremendous increase from the existing 4-hour requirement

Erich Pratt, Senior of GOA, shared the following thoughts in a statement released by the organization today:

“Despite the judge's dismissal of the complaint, his opinion contains a silver lining for New Yorkers and the nation, as the robust precedent laid out by the Supreme Court in June is clearly making headway. GOA looks forward to continuing the fight against clear violations of the Second Amendment, as we work to restore the rights of all Americans.”

U.S. Chair and NY-21 Congresswoman also chimed in on the new law that is being enacted in her home state today:

New York's law also states that individuals must assume that they are not allowed to carry firearms in private businesses unless the business posts a sign permitting them to do so.

The Associated Press noted that “the list of prohibited spaces for carrying guns has drawn criticism from advocates who say it's so extensive it will make it difficult for people with permits to move about in public. People carrying a gun could go into private business only with permission, such as a sign posted on the window … Jennifer Elson, who owns the Let's Twist Again Diner in Amsterdam, said she put up the sheriff's sign, along with one of her own reading in part “per our governor, we have to post this nonsense. If you are a law abiding citizen who obtained a legal permit to carry, you are welcome here.”

Although it may seem that the Bruen ruling may not have changed much in New York state, the Firearms Policy Coalition did celebrate a small win earlier this week. One of the plaintiffs in one of their cases involving a concealed carry applicant who had his permit denied in 2019 is now able to get one following the NYSRPA v. Bruen SCOTUS decision.

  1. They are just too stupid to learn…my favorite, other than the SCOTUS ruling against them, is when they have to pay MILLIONS in legal fees to the NRA.

  3. Well Good Show, Kathy! Now only the criminals and the understaffed, hamstrung police departments will have guns and the police will be forbidden to use them. You are a disgrace to your fighting Irish ancestors.

    • It seems like many of them are fleeing that state, the same as all logical thinking people are doing in California. It’s hard to tell which of those two states are the most screwed up by their left wing radical democrat “leaders”.
