A federal judge in Texas has approved a class action lawsuit filed by Venezuelan nationals who were detained and deported under the Alien Enemies Act (AEA), a law invoked by the Trump administration. The ruling marks a significant development in the legal battle over the government’s immigration enforcement.
On May 1, U.S. District Judge Fernando Rodriguez Jr., a Trump appointee, issued an order certifying a class of petitioners challenging their designation as “alien enemies” and subsequent removal. The group includes individuals detained in the Southern District of Texas and deported following an executive proclamation issued by former President Donald Trump in March 2025, targeting alleged members of the Venezuelan gang Tren de Aragua (TdA).
In his 12-page opinion, Judge Rodriguez acknowledged the unusual nature of the case, stating that it “presents a compelling justification to utilize a procedure equivalent to a class action.” While the government argued that each deportation under the AEA required individualized legal consideration, the judge noted that many of the legal questions raised—such as the validity of the executive order and the constitutionality of applying the AEA—are common across the group.
The lawsuit contends that the administration’s actions violated due process rights and exceeded the scope of the AEA. Petitioners argue that the law was improperly applied to a modern gang threat that does not meet the historical standard of an “invasion” or “predatory incursion” as defined in the statute. The AEA has previously only been used during major military conflicts, such as World War I and World War II.
While Rodriguez acknowledged that determining whether a specific individual is a TdA member would require fact-specific hearings, he emphasized that the broader legal questions—such as whether the AEA can be invoked in this context—are shared by all affected individuals. “A favorable result on any of these legal theories as to one individual will prove equally applicable to other Venezuelan aliens designated as alien enemies under the Proclamation,” he wrote.
In addition to certifying the class, Judge Rodriguez previously issued a temporary restraining order preventing further removals in the Southern District of Texas and later expanded that order.
The Trump administration maintains that its actions were lawful and necessary to address national security threats posed by the gang.
Critics of the ruling argue that it undermines the president’s ability to act swiftly in matters of national security and border enforcement. Supporters of the Trump administration contend that the class action opens the floodgates for deported individuals with potential gang affiliations to reenter the legal system, delaying removals and bogging down immigration courts. They argue that the Alien Enemies Act is one of the few tools available to address threats posed by transnational criminal organizations, and that the judiciary is overstepping its authority.
This case adds to a growing wave of legal pushback against Trump-era immigration policies, prompting renewed accusations of judicial activism. The president is facing an unprecedented barrage of legal challenges—many from judges appointed by Democratic presidents or perceived to be ideologically opposed to his agenda. Immigration, in particular, has become a major point of contention, with several high-profile rulings temporarily blocking or rolling back enforcement measures. Critics worry the judiciary is increasingly shaping immigration policy through the courts, rather than interpreting the law as written, thereby undermining the executive branch’s constitutional role.
If the administration appeals, the case will move to the conservative-leaning 5th U.S. Circuit Court of Appeals. Legal experts note that the outcome could set an important precedent in the ongoing battles judges across the country are taking up with the Administration.
