Former President Barack Obama made headlines last week with remarks delivered at Hamilton College in New York, where he positioned himself as a defender of free speech in the face of what he characterized as alarming threats from the Trump administration. But despite his rhetoric, critics and fact-checkers alike have noted that his track record tells a very different story.
In his speech, Obama condemned what he described as federal overreach — including what he characterized as threats to law firms and universities over political expression — suggesting President Trump would remove news outlets from the White House press corps. “Imagine if I had pulled Fox News’s credentials from the White House press corps — you’re laughing, but no, that — this is what’s happening,” Obama told the audience.
But Obama’s own history undermines those claims. Not only did his administration publicly target Fox News, it actively excluded the network from press briefings and surveilled one of its reporters — actions documented by FactCheck.org and other watchdogs.
In a 2022 speech at Stanford University, Obama encouraged content moderation by platforms like Facebook and Twitter, lamenting that existing censorship efforts “[don’t] go far enough.” He emphasized that the First Amendment doesn’t apply to private companies — a true but conveniently selective framing that critics argue was meant to justify silencing dissenting voices, particularly on the right.
Beyond the U.S., the Obama administration lent its support to international efforts to restrict speech, notably backing measures advanced by Muslim-majority nations that suppressed criticism of Islam under the guise of “anti-blasphemy” protections — proposals in direct contradiction of the First Amendment values he claims to hold dearly.
Obama’s sudden concern about law firms being allegedly punished for representing controversial clients also rings hollow. As critics point out, the former president was notoriously silent when lawyers and firms aligned with Republicans — particularly those involved in post-2020 election litigation — faced intense backlash and attempts at professional retaliation.
Even Obama’s references to protecting student protesters have been rebuffed by current officials. Secretary of State Marco Rubio pushed back, clarifying that foreign nationals engaging in radical activism under the guise of “free speech” may have violated the terms of their visas: “If you told us that’s what you intended to do when you came to America, we would have never let you in.”
The larger picture painted by critics is that Obama’s newfound concern for civil liberties is ahistorical, selective and self-serving. His administration’s history includes press intimidation, surveillance of journalists, and support for free speech suppression — all of which stand in direct contradiction to the ideals he now claims to champion.
Ultimately, Obama’s track record suggests he is less a defender of constitutional rights than a skilled political figure who invokes those rights when it suits his narrative — and abandons them just as quickly when they conflict with his agenda.
