Ray Epps Lawsuit Against Tucker Carlson Dismissed

A Delaware federal judge dismissed a defamation lawsuit filed by Ray Epps, a key figure in the aftermath of the January 6th Capitol riot, against Fox News and former primetime anchor Tucker Carlson. The ruling, issued on Wednesday, has significant implications for the press and its protections under the First Amendment, especially as it pertains to commentary and opinion-based reporting.

The defamation lawsuit stems from comments Carlson made in 2023, in which he suggested that Epps might have been a government agent or informant, a theory fueled by video footage showing Epps encouraging Trump supporters to enter the Capitol the night before the riot. Epps, who was involved in the January 6th events but not charged with any significant crimes, was filmed on January 5, 2021, urging attendees at a rally to “go into the Capitol” the following day. The video prompted widespread speculation about Epps’s role in the events surrounding the riot, with some suggesting he may have been working with federal law enforcement.

Epps denied these accusations, and while he was charged for his participation in the events of January 6, he ultimately received a probation sentence—much lighter than the sentences given to other rioters involved in the Capitol breach.

Epps’s sentencing to just 12 months of probation, despite video evidence showing him encouraging others to breach the Capitol, has sparked outrage among many conservative commentators, who believe he received preferential treatment because of his possible connections to federal authorities. Epps’s lighter sentence, compared to the harsher penalties imposed on other rioters, was widely discussed as raising questions about the FBI’s role in the event.

Epps filed the defamation suit against Fox News and Carlson in July 2023, arguing that the network’s coverage had caused him personal and professional harm, including threats against his life. His legal team argued that Carlson’s statements about Epps being a potential FBI informant were made with “actual malice” and could be proven false.

In a ruling from the bench on Wednesday, U.S. District Judge Jennifer Hall, who was appointed by President Joe Biden, sided with Fox News and Carlson. Judge Hall ruled that Carlson’s statements were protected by the First Amendment, emphasizing that Epps’s legal team had failed to demonstrate that Carlson acted with “actual malice.” To prove defamation, public figures like Epps must show that the defendant acted with knowledge that the statements were false or with reckless disregard for their truthfulness.

Judge Hall dismissed the lawsuit, asserting that Carlson’s commentary fell under the category of protected speech, particularly given the “cautionary language” used during his segments. Fox News’s legal team argued that Carlson’s statements were framed as opinions, and viewers were given the opportunity to form their own conclusions based on the presented facts. “These were opinions, not defamatory statements of fact,” Fox News’s lawyers argued in a memorandum filed with the court.

In one segment, after showing the video of Epps, Carlson said, “Once again, you can draw whatever conclusions you like from that video. We have ours and we shared them with you.”

Following the controversial $787.5 million settlement between Dominion Voting Systems and Fox News earlier this year over false election claims, many speculated that the outcome of future lawsuits against Fox News could be influenced by the precedent set by that case. However, in this instance, Judge Hall ruled in favor of the media giant, affirming that Carlson’s statements, while controversial, fell within the bounds of protected speech.
