A recently enacted Tennessee law that criminalizes the harboring of illegal aliens is now the subject of a federal lawsuit. Filed in the U.S. District Court for the Middle District of Tennessee, the suit challenges the constitutionality of the measure, raising concerns over its breadth and implications for residents and organizations across the state.
The lawsuit was filed by several groups, including the Institute for Constitutional Advocacy and Protection at Georgetown Law, the American Immigration Council, and the Tennessee Immigrant and Refugee Rights Coalition (TIRRC). Plaintiffs include the Southeastern Synod of the Evangelical Lutheran Church in America, a Tennessee landlord, and a resident who shares a home with a family member seeking asylum.
At issue is Senate Bill 0392 / House Bill 0322, introduced during the last legislative session by Rep. Chris Todd (R-Madison County) and Sen. Brent Taylor (R-Memphis). The bill was signed into law by Governor Bill Lee on May 9.
The law grants the state attorney general the authority to prosecute individuals or organizations that knowingly harbor, conceal, or aid in hiding illegal immigrants. It also expands definitions related to human trafficking and smuggling, aligning state law with federal immigration enforcement priorities.
According to the legislation, human smuggling occurs when a person knowingly transports or conceals an individual who has illegally entered or remained in the United States, with the intent of hiding them from law enforcement or immigration authorities. The law specifically references determinations made by U.S. Immigration and Customs Enforcement (ICE).
In cases where trafficking offenses involve victims under the age of 13, the law categorizes such incidents as aggravated human trafficking, which can carry significantly harsher penalties.
According to the TIRRC, the statute could potentially criminalize church offering temporary shelter, a landlord renting to a tenant, or a family member providing housing to a relative—if the person in question is in the country illegally.
The suit argues that immigration enforcement is a federal responsibility. By creating and enforcing its own immigration-related criminal penalties, Tennessee may be overstepping its legal bounds, potentially creating a fragmented national framework of inconsistent laws — though the longstanding and widespread establishment of “sanctuary states” and “sanctuary cities” may undermine this argument.
The lawsuit also claims the law fails to clearly define what conduct is considered criminal, making it difficult for Tennesseans to know what actions might lead to prosecution.
Supporters of the law argue that it will serve as a deterrent to those who may consider entering or remaining in the country illegally. They believe that by increasing the risk for those who assist in concealing individuals without legal status, the law could discourage illegal immigration overall. Some proponents also suggest the measure may encourage self-deportation—prompting individuals to voluntarily leave the country rather than face heightened legal consequences or reduced access to housing and assistance.

It is against the law to harbor and aid a known felon of the law.
They are called illegal aliens because they broke the law.
Harboring a criminal is the crime of “aiding and abetting”.
An illegal immigrant is breaking the law.
Hence harboring an illegal immigrant is a crime.
The filers of such frivolous lawsuits should be assessed all assessed all court costs, and required to reimburse the defendant’s cost of defense, when they lose.
There is a point where we Americans must put our foot down and support already existing laws and enforce them. We cannot allow other nations to abuse our borders. Religious organizations do not serve their flock by allowing laws to be broken for emotional happiness. Laws are meant to be tough on the lawbreakers.
We have laws, and if you’re NOT breaking them, you won’t have anything to worry about. There is mass paranoia because even ‘Americans’ are doing things they’re not supposed to ! This reminds me of the mass paranoia that southern California had in the early 1970’s of getting busted for drugs. So what did they do ? Eventually they made all drugs legal but that didn’t help anything at all. If you eliminate ALL laws, it won’t make things better. The motto of the Lie-berals is: No Rules, Just Right. They are going wide-open down a dead end street !
