Supreme Court Justice Neil Gorsuch said the investigation regarding the bombshell leak of a draft opinion indicating the Court’s intention to overturn Roe v. Wade is ongoing and a report is coming.
According to The Wall Street Journal:
“The chief justice appointed an internal committee to oversee the investigation,” Justice Gorsuch told the 10th Circuit Bench and Bar Conference here at the Broadmoor resort. “That committee has been busy and we’re looking forward to their report, I hope soon.”
In remarks, Gorsuch indicated he believes the leak was made public to sway the Court in a particular direction on the issue. However, the justice remained silent on whether the report’s findings would be available to the public.
“Improper efforts to influence judicial decision making, from whatever side, are a threat” to the judicial process, he said. “They inhibit our capacity to communicate with one another,” reducing the candor between jurists of different persuasions that “improves our final products,” he said. “I very much hope we get to the bottom of this sooner or later.”
Gorsuch’s comments on the draft opinion leak serve as the first update on the matter in months. In June, reports broke that the justices’ clerks had been ordered to hand over cell phones and sit for interviews with Court investigators but otherwise news on the matter has halted. Liberals and conservatives alike have each pointed fingers at the other side over who could have leaked the document. Conservatives have accused clerks working for liberal-leaning justices or a specific justice themself of leaking the draft in hopes a public outcry would sway the bench away from overturning Roe. “The leaked SCOTUS draft was likely from a far-left law clerk who is trying to derail the final decision by creating mass outrage, hoping to scare a Justice to change his or her mind,” Rep. Paul Gosar tweeted.
“If there’s not a thorough criminal investigation into who leaked privileged documents from the United States Supreme Court then we live in a clown show state. For Perspective: The FBI sent 15 people to investigate a garage pull,” Donald Trump Jr. said.
Meanwhile, liberals have claimed a conservative member of the Court likely aired the documents to prevent the Court from appearing it changed its opinion due to outside pressure and to lock in votes.
“Who leaked the SCOTUS opinion? This is incredibly rare. Only a handful of people have access to it. I bet it’s actually from the chambers of one of the hard-right justices (Alito or Thomas) to lock in one of the swing votes (Kavanaugh, say). So — what if it was Ginni Thomas?” Lawyer Tristan Snell alleged.

Personally, I would expect that it would be a law clerk for a liberal judge with very little to lose. My bet would be for someone who worked for Justice Breyer who caved to the leftist pressure and had announced his retirement, leaving his clerks with nowhere to go.
So if it was a clerk, then with the new term they are gone and back in a liberal law firm or some anti American academic s——t hole.
