Blue State Governor Refuses to Reinstate Unvaccinated Workers Despite Overturned Mandate

Arizona Democratic Sen. Ruben Gallego is launching an effort to challenge a new Trump Administration immigration policy that could require many green card applicants to leave the United States and complete the process abroad.

According to a report from The Hill, Gallego is not only seeking to overturn the policy itself but is also pursuing a procedural strategy that could make it easier for Congress to reverse the change.

The dispute revolves around a recent U.S. Citizenship and Immigration Services (USCIS) policy affecting how certain immigrants obtain lawful permanent residency.

New York Governor Kathy Hochul (D) signaled she will not allow health institutions to re-hire workers who were fired for refusing the Covid-19 vaccination despite the state’s concerning worker shortage.

According to The Daily Wire, despite the New York Supreme Court overturning the statewide vaccine mandate for medical staffers last week Gov. Hochul is unconvinced unvaccinated workers deserve the chance to re-apply for their old positions.

Since Sep. 27, 2021, the state has required healthcare workers across New York to be vaccinated against COVID-19 or be terminated. 

In his ruling, Judge Gerard Neri said the governor and the New York State Department of Health overstepped their authority by making the requirement permanent because the COVID-19 vaccine is not included in the state’s public health law.

“The mandate is beyond the scope of respondents’ authority and is therefore null, void and of no effect,” Neri said.

“Our healthcare systems are in desperate need of staff right now, we’ve had ambulances waiting five hours at our local emergency rooms to unload patients,” Rochester-based reporter Jennifer Lewketold Hochul. “The hospitals and nursing homes say they’re waiting for DOH [New York State Department of Health] guidance on whether they can hire any of those workers back. What’s the latest on that?”

The Democrat also acknowledged that the shortage is “a problem,” while claiming the answer is not to hire ousted unvaccinated workers. “I don’t think the answer is to have someone who comes in who is sick, be exposed to someone who can give them coronavirus, give them COVID-19,” the governor told Lewke. “I don’t know that that’s the right answer. In fact, I’m pretty sure it’s not.”

“I think everybody who goes into a healthcare facility or nursing home should have the assurance, and their family members should know, that we have taken all steps to protect the public health and that includes making sure that those who come in contact with them at their time of most vulnerability, when they are sick or elderly, will not pass on the virus,” Hochul added.

Lewke again pressed the governor, “Couldn’t there be other safety precautions, masking? Or other mechanisms in order to allow some of them back in? I mean we’re at crisis level here in our hospitals and nursing homes.”

The Governor claimed that she “cannot put people into harm’s way, because when you’re going to a health care facility, you expect that you’re not going to come out sicker than you went in, I think that’s something every New Yorker would expect.”

The Democrat seemed to reference the widely debunked myth that only unvaccinated individuals can pass along the virus.
