Tesla Sued For Allegedly Favoring Foreigners Over Americans

Elon Musk’s Tesla is facing a proposed class action lawsuit that accuses the electric vehicle and technology giant of systematic discrimination against American workers, allegedly favoring H-1B visa holders to reduce labor costs.

The lawsuit, filed Friday in federal court in San Francisco, claims that Tesla violated federal civil rights laws by disproportionately hiring foreign visa workers while laying off thousands of American citizens, a practice the plaintiffs describe as a form of “wage theft.”

Plaintiffs Say Tesla Discriminated Based on Citizenship

The suit was brought by software engineer Scott Taub and HR specialist Sofia Brander, both American citizens who say Tesla refused to hire or interview them because they did not require employment sponsorship. According to the complaint, both applicants were passed over for positions while the company allegedly sought out H-1B visa holders to fill similar roles.

Taub said he was told a job opening was “H1B only” and was not invited to interview for another position.

Brander, who had worked at Tesla previously as a contractor, said she applied for two roles but wasn’t granted interviews, despite her experience.

Visa Preference Tied to Lower Wages, Lawsuit Claims

The core of the lawsuit alleges that Tesla has become dependent on foreign workers through the H-1B visa program, allowing it to pay below-market wages and avoid negotiating with American workers. The plaintiffs argue that this has created a two-tier employment system that unfairly disadvantages American citizens.

The complaint cites Tesla’s 2024 employment data, alleging 1,355 H-1B visa hires and over 6,000 domestic layoffs, most involving U.S. citizens.

The practice, plaintiffs argue, amounts to a violation of Title VII of the Civil Rights Act, which prohibits employment discrimination based on national origin or citizenship status.

Musk’s Comments Fuel Controversy

The lawsuit also draws attention to Elon Musk’s own history with the H-1B visa, noting that he was once an H-1B holder himself before becoming a U.S. citizen. The complaint references a December 27, 2024 post on X, in which Musk defended the visa program and credited it with America’s technological leadership.

“The reason I’m in America along with so many critical people who built SpaceX, Tesla and hundreds of other companies that made America strong is because of H1B,” Musk wrote.

In a now-notorious reply to an X user criticizing the H-1B system, Musk escalated: “Take a big step back and F*** YOURSELF in the face. I will go to war on this issue the likes of which you cannot possibly comprehend.”

Musk later claimed his remarks were aimed at “hateful, unrepentant racists” rather than all critics of the H-1B visa.

The Broader Context: A Reversal of Roles?

Critics of the H-1B program argue that it has long displaced American workers, forcing many to train their lower-paid foreign replacements. Now, this lawsuit alleges Americans being excluded from jobs at the application stage simply because they don’t require sponsorship.

Legal experts suggest this could test how far companies can go in using visa programs for labor flexibility without running afoul of anti-discrimination laws.

“If these allegations are true, Tesla may be engaging in the very kind of hiring bias that employment laws were designed to prevent,” said a labor attorney not affiliated with the case.

What’s Next?

The case, titled Taub et al v. Tesla Inc, is filed in the U.S. District Court for the Northern District of California under case number 25-07785. It seeks damages on behalf of all U.S. citizens who either applied for jobs at Tesla and were not hired, or were laid off or fired in favor of foreign visa holders.

Attorney Daniel Kotchen, representing the plaintiffs, has declined further comment on how the legal team intends to prove systemic bias.
