Arizona Democratic Sen. Ruben Gallego is launching an effort to challenge a new Trump Administration immigration policy that could require many green card applicants to leave the United States and complete the process abroad.

According to a report from The Hill, Gallego is not only seeking to overturn the policy itself but is also pursuing a procedural strategy that could make it easier for Congress to reverse the change.

The dispute revolves around a recent U.S. Citizenship and Immigration Services (USCIS) policy affecting how certain immigrants obtain lawful permanent residency.

Newly released body camera footage has shed light on the troubling circumstances surrounding Kilmar Abrego Garcia—a Salvadoran national with alleged MS-13 gang ties—who was deported by the Trump administration and is now detained in El Salvador’s notorious Terrorism Confinement Center.

The video, captured during a 2022 traffic stop by the Tennessee Highway Patrol, shows officers expressing concern that Abrego Garcia was likely engaged in human trafficking. The footage has reignited debate over immigration enforcement and the judicial tug-of-war over deportation authority.

Abrego Garcia was pulled over while driving a vehicle loaded with eight other adult males. The officers immediately suspected that the situation was more than just a carpool to a job site.

“He’s getting paid to haul these people, probably to Maryland, I would say,” one officer is heard saying in the video. Another noted that the vehicle appeared to have been modified, possibly to accommodate more passengers, suggesting a deliberate effort to smuggle people. “Sometimes they come in with dope,” an officer added, referencing the common overlap between human and drug trafficking.

Abrego Garcia presented an invalid Maryland driver’s license, while none of the other passengers had identification. He initially told officers they were returning to a construction job in St. Louis, Missouri, but later claimed they were headed to Maryland before returning to Missouri for work. He also said the vehicle belonged to his boss in Houston, Texas. The inconsistent statements heightened the officers’ suspicions.

Despite strong indications that Abrego Garcia might be trafficking undocumented migrants, Tennessee law enforcement officers were reportedly instructed by the FBI not to detain him. According to sources cited by Fox News, ICE also failed to respond to calls from the highway patrol. The decision not to detain Abrego Garcia despite the clear red flags raised questions about the federal government’s commitment to enforcing immigration law.

The incident occurred during a period of looser federal enforcement protocols under President Joe Biden’s administration, which critics argue has allowed individuals with serious criminal ties to evade detention.

Abrego Garcia was deported to El Salvador shortly after Trump returned to office, where he is now imprisoned in the high-security Terrorism Confinement Center. His deportation drew international attention, especially after Democratic politicians traveled to El Salvador to visit him and advocate for his return to the United States.

Newly released court documents paint a disturbing picture of Abrego Garcia’s behavior prior to his deportation. According to sworn testimony, he allegedly threatened to kill his wife and claimed he could do so without consequences.

“He kicked me, pushed me, slapped me in the face and threatened me,” his wife said in the documents. “I also have a [recording] that [he] told my ex-mother-in-law that even if he kills me no one can do anything to him.”

Despite these allegations and his suspected trafficking activity, the U.S. Supreme Court ruled that the Trump administration must “facilitate” his return—a ruling that has sparked widespread criticism.

Salvadoran President Nayib Bukele has made it clear that he has no intention of returning Abrego Garcia to the United States. During a recent Oval Office meeting, Bukele dismissed the notion entirely.

    This is what the democratic party has set its sites on protecting, an allien criminal with ties to one of the most recognized crimial gangs in the Americas. They have 4 members of Congress travel to San Salavdor to attempt to negotiate to bring him back to the USA, which is a violation of the Logan act, we have judges to are making legal state level demands that actions outside the USA control happen to being him back to the USA of the President of San Salavdor. Just who do these Congressional Members think they were elected to represent, illegal allien criminals or American citizens?
    The proper out come of this should be that Arbego Garcia should stay in prison in San Salvador, the four members of Congress should receive a Speaker of the House should issue a rebuke for their unauthorized travel and volation of the Logan act, as well as refuse to pay for their travel and AWOL time. Judges who have supported or put road blocks in the due process of law, should be debenched, and not issued any more cases by the SCOTUS from the department of Justice. Any further acts contrary to the laws and Constitution should be viewed as justification for charges, arrests, detainment, and removal from any govement position and/or trial and possible imprisonment.
