DALLAS — Dallas County prosecutors say they do not intend to seek the death penalty against Yordanis Cobos-Martinez, an illegal immigrant charged with killing and beheading a Dallas motel manager in front of his family. The decision shocked many who viewed the crime as one of the most brutal the city has seen in years.
Prosecutors Hold Off, but Leave Door Open
At a Nov. 20 hearing, the Dallas County District Attorney’s Office told a judge it would not pursue capital punishment at this stage. Prosecutors said they could revisit the decision if circumstances change, and they plan to give the court a final answer by early January.
For now, Cobos-Martinez remains in the county jail under a capital murder charge. He is also being held on an immigration detainer.
A Crime That Shocked the Community
Authorities say the attack happened after a workplace argument at the Downtown Suites motel, where both men were employed. Investigators accuse Cobos-Martinez of retrieving a machete, striking coworker Chandra Nagamallaiah, then decapitating him and placing the head in a dumpster.
The grotesque nature of the details prompted widespread outrage. Public safety advocates and several community leaders have questioned why prosecutors declined to pursue the maximum penalty, especially given the severity of the crime.

“Based on our investigation and my conversations, the state of Texas is not seeking the death penalty,” prosecutor Julie Johnson told the court during a Nov. 20 hearing. “But we reserve the right to change our mind should anything come up.”
Police say that Cobos-Martinez attacked Nagamallaiah after he asked Cobos-Martinez’s co-worker to translate a request not to use a broken washing machine. Surveillance footage then showed Cobos-Martinez pulling out a machete and attacking Nagamallaiah, the Dallas Express reported, before he kicked the motel manager’s head like a soccer ball before tossing it into a dumpster.
“I am aware of the terrible reports regarding the murder of Chandra Nagamallaiah, a well respected person in Dallas, Texas, who was brutally beheaded, in front of his wife and son, by an ILLEGAL ALIEN from Cuba who should have never been in our Country,” President Donald Trump posted on Truth Social days after the murder.
“This individual was previously arrested for terrible crimes, including child sex abuse, grand theft auto, and false imprisonment, but was released back into our Homeland under incompetent Joe Biden,” Trump continued.
Some possible factors, such as motive, mental health evaluations, or other background findings, may have influenced the DA’s early position. The office has not offered a full explanation.
What Comes Next
Prosecutors are expected to revisit the death penalty question on Jan. 8, 2026. They could still reverse course if new evidence or aggravating factors emerge.
The case is moving toward trial under a capital murder indictment, though no date has been set.
Given the severity of the allegations, public scrutiny is unlikely to fade. Supporters of tougher sentencing and stronger immigration enforcement are expected to watch the next steps closely as the case moves forward.
