Marine Vigilante Surrenders To New York Authorities – As New Video Emerges

Despite a new video showing Marine veteran putting in the recovery position after restraining him amid compliments from passengers on the subway Jordan Neely was threatening, Manhattan District Attorney indicted Penny, 24, on the charge of 2nd-degree manslaughter.

If convicted, Penny faces up to 15 years behind bars.

It's unclear why Neely stopped breathing and what exact measures first responders took to help him try to regain consciousness. An eyewitness described Neely as “starring off” and “limp” after Penny put him in a chokehold. The retired Marine restrained Neely for several minutes after he began shouting at passengers that he didn't care that he didn't care if he lived, died or was arrested.

Neely had over 40 criminal convictions and an outstanding warrant for assaulting an older woman.

City Mayor (D) initially defended Penny's actions. Days later, he sounded more in line with Alexandria Ocasio-Cortez and other progressive activists who had demanded Penny's arrest.

A judge agreed to release Penny, a 24-year-old college student, on a $100,000 bail package signed off by prosecutors and secured by bondsman Ira Judelson.

Penny turned himself into police early Friday for fatally choking the erratic homeless man May 1 on a northbound F train in a case that has polarized New York City.

Penny's attorney, Thomas Kenniff, said the young man, who is one week shy of graduation from college, acted to protect himself and other passengers who were being threatened.

Meanwhile, a witness who was on the subway when Penny put Neely, 30, in a chokehold told the New York Post she “was praying for him.”

The 66-year-old said Neely was “threatening the passengers.”

  1. I have been saying it for decades, criminals have more rights than the citizens. If the authorities are really concerned about their criminals, then they should put them in protective custody, because the working people have reached their limit!

    • That’s exactly what they want, and they think they can win. That’s the reason for them pushing for the disarming of America/Americans, because if they don’t they are going to get their azz kicked.

    • Yes indeed. It began way back in the 1960’s. Even my mother noticed that a few renegade judges were lamenting: ‘Oh, the poor criminals!’ But what about their poor victims?

  2. Why Label this Marine as a “ Vigilante” and not what he was, a Samaritan intervening to ‘help’ others? Being now charged for a crime, sends the message that intervention in any altercation will put YOU in jeopardy. As has happened in the past, people will only watch while some attack, possibly deadly, is ongoing!

    • I thought that was odd, too. He was anything BUT a vigilante! He was protecting and saving other people’s lives, and is now being punished for it. Considering the racial differences, though, it’s not surprising, and especially coming from NYC.

    • Charging this Marine after he and others restrained Neely who was acting out and threatening the subway riders in the car with manslaughter, a serious crime, sends the message to all not to try to help protect others who are in danger from an assailant, especially if the perp is a minority. The Marine and the other helpers were acting in self defense of the other riders from a real threat of harm. The death was not intended and the restraint was done for a legal purpose.

These disgusting politicians in NY and around the country let hard core criminals off the hook, yet because of the trash that go out and protest they bring this young former Marine in and charge him. How many people could be dead if the Marine had not acted? Bragg, AOC, that slime-bag Al Sharpton should all be thrown out of the country. I could say what I really think but I’d be banned.

  4. And had Neely been a White man, this would probably never have reached the news outside NYC!! Is anyone else sick of the “poor-pitiful-me-I’m-so-picked-on” claims and whining we hear constantly?? Getting pretty old to me.

  5. New York is on a roll – like a steam roller. Couldn’t put a man with 40 some arrests into a home for the mentally ill which he seemed to long for. He wanted someone to put him in jail, he couldn’t fend for himself anymore so turned to crime to try to force someone to care for him. Uh-uh, no dice.
    But they go after someone who tried to help his fellow passengers from being pushed around by the mentally ill man. The young man who tried to help now needs help himself. What a sad, scary place to live in, New York, New York, it’s an unwonderful town.

  6. How dare he be called a Vigilante! He is a HERO, and I hope more people follow his lead. I am sick of the BLM, Democrats, and Communists in this country who make martyr’s out of criminals. I don’t care what their nationality, race, religion, or whatever are, they are still criminals and I will give generously to this Young Marine’s defense fund.

  7. As far as I am concerned, GOD placed Dan Penny in the Subway train, at the right place and at the right time. NYC needs to stop picking the crimes that they want to prosecute and I did not hear from Al Sharpton when in 2018, the military veteran was stabbed 9 times by a gang of thugs in Harlem and left dead in the middle of the street. Manhattan DA Alvin Braggs makes a plea bargain with the criminals. Where were the NYC protesters then?

  8. They’re going to tear the City down? they already are and have been doing it for years. The big cities are not fit for decent people to live in. Plus, when you’re lucky enough to have a Mayor like, (DUMBO) Adams, who tells more criminals and nut jobs and other garbage, to come on in, you’re welcome here, it’s going to happen even faster. Wonder what makes Democrats so stupid?
