Arizona Democratic Sen. Ruben Gallego is launching an effort to challenge a new Trump Administration immigration policy that could require many green card applicants to leave the United States and complete the process abroad.

According to a report from The Hill, Gallego is not only seeking to overturn the policy itself but is also pursuing a procedural strategy that could make it easier for Congress to reverse the change.

The dispute revolves around a recent U.S. Citizenship and Immigration Services (USCIS) policy affecting how certain immigrants obtain lawful permanent residency.

Federal Restraint Signals Blow to Executive Power on Domestic Military Use

PORTLAND, Ore. — A federal judge has temporarily barred the Trump administration from sending Oregon National Guard troops — or any out-of-state National Guard units — into Portland in connection with ongoing protests near a U.S. Immigration and Customs Enforcement facility.

The decision granting a restraining order came from U.S. District Judge Karin Immergut, a Republican appointee of President Donald J. Trump, just days before her final ruling is expected.. It follows a lawsuit by the State of Oregon and the City of Portland, who argued that the federal deployment lacked both justification and legal grounding.


Rebuking the Government’s Claims

In her ruling, Immergut called the administration’s justification for military intervention “untethered to the facts.” The federal government had labeled Portland a “war-ravaged” city and described the protest activity as warranting a military response — claims the court found to be exaggerated and unsupported.

Local officials noted that recent protests have been relatively small and peaceful. The administration’s characterization, the state argued, was a “wildly hyperbolic pretext” for federal overreach.


Federal vs. State Authority on Display

While the order is not a final ruling, it underscores deeper constitutional issues, particularly the limits of presidential power to deploy military forces domestically.

The Posse Comitatus Act, which restricts the use of federal troops in civilian law enforcement, and the 10th Amendment’s protection of state sovereignty are both central to the legal battle.

Immergut made clear that using military force in civilian contexts blurs critical lines between federal authority and local governance.


Deployment Threats Continue

This isn’t an isolated incident. The Trump administration has repeatedly floated or initiated troop deployments to cities facing strife — a pattern that has drawn criticism from progressive leaders and civil liberties advocates alike.

Portland’s protests have been a thorn in the Trump administration’s side for months, The Hill reports:

Trump called up hundreds of members of the Oregon National Guard in September, saying it was necessary to combat violent opposition to officers at an Immigration and Customs Enforcement (ICE) facility in Portland.

It’s one of several cities where the president has deployed the National Guard. His deployments to Los Angeles, Chicago and Washington, D.C., have also come under legal challenges.

In Portland, Trump points to a federal law enabling him to federalize the guard when there is an invasion, rebellion or an inability to execute the laws with “regular forces.” Trump contends the last two conditions have been met, saying ICE officers have been threatened, doxxed and even trapped in their cars.

But the judge, a Trump appointee, in her ruling Sunday wrote that the ICE facility protests were “generally uneventful” with only “occasional” interference to federal personnel.

In her written opinion, Immergut acknowledged that, while some unlawful acts had occurred, the authorities on the ground were fully equipped to respond. “Although there were sporadic instances of unlawful behavior, federal law enforcement, along with local law enforcement, were able to manage the situation and arrest and prosecute those responsible for criminal conduct,” she wrote.


Next Steps

Trump may have been stopped, but not stripped of control. Sunday’s order blocks the use of National Guard troops to patrol Portland but leaves the federalization order in place, meaning the troops remain under federal authority.

Immergut’s final ruling could set a lasting precedent for how far Washington can go in using military force on American streets.

    As conservatives we need to understand our Judicial branch has been infiltrated and controlled by the deep state or intel communities. There is a shadow government that controls Judges(even some Trump appointees), DA’s, media and the democrat party.

    If a Judge will not allow law enforcement to enter Portland, just cut off all federal aid, station ICE and LEO’s around the city and as as Nero did, let the fiddle while Portland burns. Sooner or later the quiet majority will stand up and say enough and remove those Sorros Paid Judges.

    “Ongoing protests”? Are you kidding? These are organized attacks on federal law enforcement officers. Without the National Guard to protect them, ICE agents may well need to protect themselves with deadly force when vastly outnumbered.
