In a late filing on Monday, former President Trump's legal team acknowledged he could face criminal charges stemming from the FBI's Mar-a-Lago raid in August.
Last week, U.S. District Judge Aileen Cannon officially tapped Raymond Dearie, a former chief judge of the U.S. District Court for the Eastern District of New York who also served on the Foreign Intelligence Surveillance Court, to serve as the special master in the case. In a nod to the Justice Department, Judge Cannon also requested the special master prioritize the review of the 100 documents marked as classified to determine if they were in fact mishandled by Trump. The former president has publicly claimed all records seized by the FBI were declassified, however, his lawyers have yet to make the declassified claims in federal court.
In its filing, Trump's team expressed hesitancy to provide specifics on what may have been declassified because the issue may be a defense against future criminal charges.
Trump's lawyers wrote that, if they were forced to disclose this specific declassification evidence, “the Special Master process will have forced the Plaintiff to fully and specifically disclose a defense to the merits of any subsequent indictment without such a requirement being evident in the District Court's order.”
“The Draft Plan requires that the Plaintiff disclose specific information regarding declassification to the Court and to the Government,” Trump's lawyers said Monday. “We respectfully submit that the time and place for affidavits or declarations would be in connection with a Rule 41 motion that specifically alleges declassification as a component of its argument for return of property.” Rule 41 relates to motions seeking to have cases dismissed.
Unsealed court filings revealed that Trump is being investigated under the Espionage Act as well as related to laws regarding obstruction of justice. However, the FBI's ability to use the records seized from Mar-a-Lago in its criminal investigation was been put on hold as Judge Cannon appointed a special master to independently review the materials.
However, at the time of appointing the special master, Judge Cannon also offered clarification on how the DOJ might continue its criminal investigation while the documents are reviewed by the special master. The judge listed moves such as “questioning witnesses and obtaining other information about the movement and storage of seized materials, including documents marked as classified, without discussion of their contents” as ways the DOJ may continue its investigation.

Trump may or may not have committed a “crime” but my thought is that if he did he was fed erroneous information to lead him down the path. There have been people on his staff who were less than honest and who would have gladly made the President look foolish and come out against him when needed. Trump’s biggest failure when he took office was not firing every person in our government that was appointed or hired by the America hating obama. They were there to do as much damage as they could get away with, that’s why obama stuck them in the positions to begin with.
Personally I think that Trump wants to be brought up on charges. That sets a precedent and means that they will also have to go back and look at Bush, Obama and Clinton and what files they took home. The FBI will also be called to account for the evidence that went missing from Anthony Weiner’s laptop, from HIllary Clinton’s trove of emails and classified that she had on her home brewed servers, where Epstein’;s client lists and videos secretly recorded from every room of every home Epstein owned – disappeared to. Ghislaine Maxwell was sentenced to prison for trafficking underaged girls for sex – BUT – we don’t know the name of one person whom she allegedly trafficked these girls to – Why? Those people are every bit as guilty as Maxwell. I have wondered if that so called “informant” was not also a plant or a “rat” that was discovered and fed false information that Trump’s people knew would get back to the FBI. The raid on Mar-A-Lago was a disaster for the FBI – first they eliminated any witnesses to their raid by not allowing Trump’s attorney to be present, then they ordered the security cameras turned off. What were they doing that they did not want anyone to see? Did they plant evidence? I certainly don’t know – but – they certainly had the opportunity to do so. That creates a Reasonable Doubt as to any charges they may have planned to bring.Lastly, those documents that Trump allegedly has are so top secret that they are a threat to national security. Such a threat that they waited a year to go get them – or even worse they did not even know were missing – for a year and a half? Then they sat on the warrant for another week? Documents that go that high up require extremely high security clearances not the type of clearances that FBI field agents have. So why were they sent to retrieve them?

I read elsewhere that Trump had ordered documents related to the attempt to frame him for collusion to be declassified. I believe that the documents in question pertain to the attempt to frame him.
This is really scary. A government that is so intent on framing and persecuting a man whose presidency was all about shrinking the government and making it more responsive to the people will have no compunctions about eliminating less powerful threats to its power. There is enough talk among socialists about the “need” to eliminate Republicans that we should be quite worried.

But most importantly they must all be held to their oath of office and not be allowed to be neglectful or in disregard of their solemn oath. Be it willful or wanton without remedy or repercussion from the citizens that they purport to represent and work for. Criminals deserve to be punished for their crimes!! Americans deserve transparency, honesty and to be represented by those they elect to “serve them.”
