Amid increasing dissatisfaction from Democrats, President Joe Biden’s team is making strategic moves to solidify his standing as the party’s presidential nominee. By pledging significant reforms to the Supreme Court, the aging commander-in-chief aims to address the concerns of progressives who have long sought to change the court.
For years, but particularly since the Supreme Court overturned Roe v. Wade and ruled that presidents are exempt from prosecution for exercising fundamental constitutional powers, the far-left of the Democratic Party has been urging the president to take decisive action against the court.
In a recent call with the Congressional Progressive Caucus, Biden outlined his key objectives, signaling a commitment towards addressing these leftist demands.

“I’m going to need your help on the Supreme Court, because I’m about to come out – I don’t want to prematurely announce it – but I’m about to come out with a major initiative on limiting the court … I’ve been working with constitutional scholars for the last three months, and I need some help,” Biden told the caucus, according to a transcript of the call obtained by The Washington Post.
Proposing Term Limits for Justices
Biden is reportedly considering proposing term limits for Supreme Court Justices, a move that has sparked both support and criticism. Term limits, whether based on age or years of service, could bring significant changes to the judiciary.
Critics maintain that lifetime tenure:
- Shields justices from political pressures and public opinion.
- Allows decisions to be made based solely on legal interpretation.
Enforcing a Code of Ethics
Another major proposal from Biden is the introduction of an enforceable code of ethics for the Supreme Court. This proposal ostensibly aims to enhance transparency, accountability and integrity within the nation’s highest court.
However, opponents raise concerns about:
- Separation of Powers: Imposing a code of ethics could infringe on judicial independence by subjecting the judiciary to external pressures.
- Self-Governance: The Supreme Court has traditionally managed its own ethical standards, and critics believe that justices are capable of self-regulation without external mandates.
Despite the ambitious nature of Biden’s proposals, their implementation faces significant hurdles. With Republicans controlling the House of Representatives, obtaining the necessary congressional approval for these changes appears unlikely in the current session.

However, a Democratic-controlled Congress could make these radical reforms much more attainable.
