On Tuesday, a federal judge blocked the Trump administration-era Title 42 immigration policy that permitted border agents to expel immigrants from the country quickly.
D.C. federal district court Judge Emmet Sullivan ruled the policy was in violation of the Administrative Procedures Act, effectively preventing the Biden administration from implementing the policy to curb his border disaster‘.
The Tuesday decision “declares the Title 42 policy to be arbitrary and capricious in violation of the Administrative Procedure Act and permanently enjoins defendants and their agents from applying the Title 42 policy,” according to Sullivan's 49-page opinion.
Sullivan criticized the CDC's order that allowed the policy to go into effect in 2020, saying it “ignore[d] the harm that could be caused.” He noted the agency failed to consider other options, such as allowing immigrants to self-quarantine in homes of U.S.-based friends, family, or shelters and noted the CDC should have reexamined its approach when COVID-19 vaccines and testing became more widely available in 2021.
“With regard to whether defendants could have ‘ramped up vaccinations, outdoor processing, and all other available public health measures' … the court finds the CDC failed to articulate a satisfactory explanation for why such measures were not feasible,” Sullivan added.
Title 42 was initially implemented at the start of the Covid-19 pandemic to deter illegal immigration but the Biden administration has relied on it to manage the historic influx of immigrants at the U.S.-Mexico border.
Since President Biden took office nearly 4 million people have been encountered attempting to enter the U.S. illegally, a record-shattering number that doesn't include the number of migrants that managed to evade arrest.
More than 81,000 people were still processed using the policy in October, according to U.S. Customs and Border Protection data.
The CDC initially attempted to end the Title 42 order earlier this year, asserting it was no longer necessary given the decreased threat of the pandemic. However, a federal judge blocked the administration from ending Title 42 in May.

Unless Biden does something extraordinary the Southern Border is going to explode. This is the same judge that toyed with Michael Flynn for 3+ yr., including calling him guilty of treason at one point because he took what the DOJ submitted as absolutely true. He also kept Flynn hanging when the DOJ (Barr) dismissed the case, putting a retired judge on the case whose job it was to find reasons for NOT dismissing the case.
As I recall, he had 2 sons, at least 1 of the 2 sons was a drug addict/ dealer who was arrested twice but Judge Sullivan managed to get both case files “lost” & he was not prosecuted. One case involved the rape or sexual assault of a minor teenaged girl.
It’s also rumored that he & another alum have been sucking money out of Howard University. So chances are a cartel or government contractor who’s sucking us dry to relocate illegals from the border is paying him a handsome fee.
This judge should be forcibly retired because he clearly is ignoring our laws, including the reason for Title 42 in the first place. Foreign nationals coming here legally STILL have to be vaccinated, but break our laws & come here illegally, you don’t. WTF?

This Judge was appointed by Obama, so you know he is on a leftist bent, he is smacking America with an assured open border from now on. I’m sick and tired of millions of illegals casually coming across our border to put their name in to start collecting all the social benefits of welfare. They’ll live better than the taxpaying Americans who are forced to give up their hard earned money to support this criminal Biden Administration.
Biden should be impeached along with our DHS Secretary who tells us under oath the border is secured. We see with our own eyes the thousands of illegals pouring over our open borders. This is a direct afront to all Americans. One has to wonder after this last midterm election Americans are still voting these communists on the Democratic side into office. We have reached a point now where 50% of America pays no taxes and the other 50% is being smothered with taxes coming from all directions. The fact that the Republicans did achieve a slight victory by winning a majority in the house, its little comfort knowing that many are Rino creme puffs who more than likely would vote on the Democratic side. We are in the precipice of losing our freedoms and liberty, the 2nd amendment is the only thing truly standing up for freedom. Lock and load if and when the time comes to take our country back. Emmet Sullivan is not a real judge, since he was appointed by Bill Clinton. A real judge needs to overturn this!
Sullivan is the same crooked political judge who refused to follow the law in his biased corrupt attempt to get General Flynn…he should be removed from the bench as he makes a mockery out of the law!
