Justice Department Appeals Motion to Appoint Special Master in Trump Raid

On Thursday, the Department of Justice announced its plan to appeal U.S. District Judge Aileen Cannon‘s order to appoint a special master to review the materials seized during the 's raid of Trump's residence.

In the notice of appeal filed in the Southern District of Florida, the DOJ requested a partial stay on Judge Cannon's motion.

Fox News reports:

“The government respectfully requests that the Court rule on this motion promptly,” the DOJ filing states. “If the Court does not grant a stay by Thursday, September 15, the government intends to seek relief from the Eleventh Circuit.”

“A stay as to that limited set of records is warranted for three reasons,” the DOJ wrote. “First, the government is likely to succeed in its appeal of the Order as it applies to classified records,” the DOJ states, adding that Trump “does not and could not assert that he owns or has any possessory interest in classified records; that he has any right to have those government records returned to him; or that he can advance any plausible claims of attorney-client privilege as to such records that would bar the government from reviewing or using them.”

“Second, the government and the public would suffer irreparable harm absent a stay,” the DOJ wrote.”Third, the partial stay sought here would impose no cognizable harm on Plaintiff,” the DOJ writes. 

“It would not disturb the special master's review of any other records, including any personal materials or records potentially subject to attorney-client privilege.””The government has already reviewed the classified records, and the Court's order contemplates that it may continue to do so for certain national security purposes,” the DOJ continued. 

The DOJ continued in its filing that the department seeks to “continue to review and use the same records” as the Plaintiff.

On Monday, Judge Cannon officially granted Trump's request an independent special master be appointed to review the seized materials despite the DOJ claiming the move was “unnecessary.” Cannon's motion forced the DOJ to immediately halt its investigation. Judge Cannon appointed the special master to review “personal items and documents and potentially privileged material subject to claims of attorney-client and/or executive privilege,” the order states.

Immediately following the raid Trump claimed the FBI took personal documents from Mar-a-Lago including passports and medical records. Cannon's Monday filing seemed to corroborate the former President's claim.

“According to the Privilege Review Team's Report, the seized materials include medical documents, correspondence related to , and accounting information,” Cannon wrote.

    • Guess they haven’t got everything copied yet, and the new material they want to add to the boxes isn’t ready yet. Nothing is too low for the left to do, legal or otherwise.

  1. Of course the slimy DOJ run by the Snake will not allow the exposure of the President (“O”Biden) for his blatant attempt to stop Trump, at all odds, to keep him from crushing the Buffoons stay in His Crib in the basement of OUR White House.

  2. Like the DOJ is actually going to halt it’s “investigation”. Yeah, right – and I have a bridge on the moon I’d like to sell.

  3. The FBI probably planted stuff in Trumps house. I would not trust anything they do or anything this Government says or does. Cause in my opinion they are out to get Trump any way they can. Legal or not legal. They have shown their corruption in the past and being partial to Democrats.

  5. Seems to me there are a few problems with the DOJ’s partial stay and appeal.

    1. They once again ignore the fact that they have personal records, client/privileged documents, and executive privileged material that the federal government has no right to have–much less seize.
    2. They totally ignore the fact that the President has the unilateral authority to declassify material–much less that there is clear evidence Trump, when he was President did so on at least some of these materials.
    3. The DOJ wants the court to rely solely on their assessment of what they have even though they have not been and are not now being truthful. In point of fact, their lies and lack of candor is the very reason the judge ordered a review by a grand master. The government has already shown it cannot be trusted.
  6. Pretty much what you would expect from these commies using our laws and courts against us. If you don’t do what we want, we’re going to go to a judge who will. Does any judge in the US have jurisdiction to prosecute Trump but you have to use specific judges to prosecute any commie? Seems like there is a judge who will side with the commies, no matter what, although sometimes it seems for a while like a patriotic judge has sided with Trump, his supporters, conservatives, Republicans, anybody who is not aligned with the commies in the White House. But in the end, a judge turns up somewhere (maybe they pay them in some fashion), who does what they want. It must be criminal, but why hasn’t anybody in the “justice” system done anything about it. Time to take out the trash. Past time.
