New York Attorney General Letitia James (D) has filed a civil fraud lawsuit against former President Donald Trump and three of his children: Don Jr., Ivanka and Eric, alleging business fraud.
The move by James’ office comes on the heels of a years-long civil investigation into the Trump family’s real estate business, the Trump Organization. The investigation has centered on whether the former president’s company misled investors and tax authorities by inflating property values to get investments and subsequently deflating them to get tax and loan benefits.

The defendants also include the Trump Organization, other Trump-affiliated businesses and two longtime executives, ex-Trump Organization CFO Allen Weisselberg and Weisselberg’s right-hand man, Jeff McConney.
The New York AG’s lawsuit comes after she rejected an offer from the former president’s legal team to settle the civil investigation into his business.

In the more than 200-page lawsuit, Attorney General Letitia James, a Democrat, alleges the fraud touched all aspects of the Trump business, including its properties and golf courses. According to the lawsuit, the Trump Organization deceived lenders, insurers and tax authorities by inflating the value of his properties using misleading appraisals.
“These acts of fraud and misrepresentation were similar in nature, were committed by upper management at the Trump Organization as part of a common endeavor for each annual Statement, and were approved at the highest levels of the Trump Organization – including by Mr. Trump himself,” the lawsuit states.

James said she believes state and criminal laws may have been violated and referred the matter to the US attorney’s office for the Southern District of New York and the Internal Revenue Service.
James is seeking $250 million in allegedly ill-gotten funds and to permanently bar Trump and the children named in the lawsuit from serving as the director of a business registered in New York state. She is also seeking to cancel the Trump Organization’s corporate certificate, which, if granted by a judge, could effectively force the company to cease operations in New York state.

The New York AG has honed in on allegations Trump fraudulently inflated the value of his assets and has mounted a years-long inquiry. Trump has denied all wrongdoing and derided the investigation as a politically motivated witch hunt. James, a Democrat, is seeking another term as the state’s AG after abandoning a campaign for governor earlier this year.
If the case goes to trial and Trump loses, a judge could potentially impose financial penalties and restrict the former president’s business operations in New York — all potentially in the midst of a 2024 presidential campaign that he is expected to join.
It is possible that James, as part of her lawsuit, could seek to curtail Trump’s Manhattan real estate portfolio, though she has given mixed signals publicly about what sort of punishment she will seek to impose.
Trump has long dismissed the investigation as a “phony years-long crusade” against him and criticized James for the inquiry.
